Condition Details / Information Notes
The application proposes development within the open countryside outside any defined development boundary which does not accord with the provisions of Policy SWDP2 of the South Worcestershire Development Plan 2016. While the proposal is for affordable housing, the proposal is not small scale, relative to the size of the village, there is not sufficient proven and unmet need for the development at the scale or type proposed and it has not been demonstrated that the proposal cannot be accommodated within the development boundary contrary to Policy SWDP16. The proposal would therefore fail to safeguard/enhance the open countryside and encourage the use of effective use of brownfield land contrary to Policies SWDP2 and SWDP16 of the South Worcestershire Development Plan (2016). Furthermore, Wychavon District Council can demonstrate a 5 year housing land supply which gives full weight to the policies contained within the adopted development plan. The environmental and technological benefits of the proposal fail to provide justification to depart from the adopted strategic policies contained within the development plan.
The application proposes the development of a significant area of open land on one of the principal routes into Bretforton. Policy SWDP25 of the South Worcestershire Development Plan 2016 requires all major development proposals to be accompanied by a Landscape and Visual Impact Assessment (LVIA) and for development proposals to take into account the latest Landscape Character assessment and its Guidelines and ensure they are appropriate to and integrate with the landscape setting and conserve and where possible enhance the primary characteristics defined in character assessments and important features of the Land cover parcel. Insufficient information has been submitted with the application to demonstrate that the proposal would not harm the landscape or visual amenity of the wider area. As such the proposal is contrary to Policy SWDP25 of the South Worcestershire Development Plan 2016.
The Preliminary Ecological Appraisal submitted with the application identifies the need for further surveys to be carried out to ascertain whether protected species are present on or are using the site. The absence of the recommended surveys means that the impact of the proposals on biodiversity and geodiversity cannot be properly assessed by the Local Planning Authority and it is not therefore possible to conclude that that proposal would conserve and where practicable, enhance the biodiversity of the site and protected species. The proposal is therefore contrary to Policy SWDP22 of the South Worcestershire Development Plan 2016 and Paragraph 175 of the National Planning Policy Framework.
Insufficient information has been submitted with the application to demonstrate that the development will minimise demand for travel and offer genuinely sustainable travel choices and allow the impact of the development on the safety and free flow of the local highway network to be assessed. The proposal is therefore contrary to Policy SWDP4 of the South Worcestershire Development Plan 2016 and paragraphs 108 and 110 of the National Planning Policy Framework 2019.
Insufficient information has been submitted with the application to allow the Local Planning Authority to assess whether the proposals will increase the risk of flooding on the site or elsewhere and it has not been demonstrated that site drainage and run off will be managed in a sustainable and co ordinated way that mimics the natural drainage network. The proposal is therefore contrary to Policies SWDP28 and SWDP29 of the South Worcestershire Development Plan 2016.

Positive and Proactive Statement. In dealing with this application, the Council has worked with the applicant in the following ways: - providing pre-application advice; - seeking further information following receipt of the application; - seeking amendments to the proposed development following receipt of the application. In such ways the Council has demonstrated a positive and proactive manner in seeking solutions to problems arising in relation to the planning application. This is in accordance with paragraph 38 of the NPPF.  Despite these efforts, the Council still consider that planning permission should be refused for the reasons set out above.
