Condition Details / Information Notes
The development hereby permitted shall be begun before the expiration of three years from the date of this permission. Reason: To conform with the requirements of Section 91 of the Town and Country Planning Act 1990 as amended by Section 51 of the Planning and Compulsory Purchase Act 2004.
Unless where required or allowed by other conditions attached to this permission/consent, the development hereby approved shall be carried out in accordance with the information (including details on the proposed materials) provided on the application form and the following plans/drawings/documents – 4909 21A - barn 1 proposed floor plans 4909 22A - barn 1 proposed elevations 4909 31 - barn 2 proposed floor plans 4909 32 - barn 2 proposed elevations 4909 41A - barn 3 proposed floor plans 4909 42A - barn 3 proposed elevations 4909 60B - plots 2, 3 and 4 plans 4909 70B - proposed site plan 4909 71B - proposed location plan 4909 50B - plot 1 plans 4909 73 - indicative street scene 4909 81 - proposed garage Reason: To define the permission.
The development hereby permitted shall not be occupied/first used until full details of all foul and surface water drainage systems to serve the development have been submitted to and approved in writing by the Local Planning Authority. The approved drainage works shall be implemented in accordance with the approved details before the first occupation/use of the development hereby permitted and shall be retained thereafter. Reason: To ensure development would not result in unacceptable risk of pollution or harm to the environment and to ensure the proposed development does not exacerbate flood risk and deals with surface water run-off from the site in a sustainable manner, in accordance with policies SWDP28, SWDP29 and SWDP 30 of the South Worcestershire Development Plan.
The development hereby permitted shall not be brought into use until the access, turning area and parking facilities have been properly consolidated, surfaced, drained and otherwise constructed in accordance with details to be submitted to and approved in writing by the Local Planning Authority and these areas shall thereafter be retained and kept available for those uses at all times. Reason - In the interests of highway safety and to ensure the free flow of traffic using the adjoining highway.
No development shall take place until an ecological mitigation and enhancement scheme has been drawn up by a suitably qualified ecologist, submitted to and approved in writing by the local planning authority. The scheme shall be based on the recommendations contained within section 4 of the Preliminary Ecological Appraisal and Great Crested Newt eDNA Sampling report by Worcestershire Wildlife Consultancy dated October 2016 and shall include: - Bat mitigation and enhancement measures; - Precautionary working methods for great crested newt risk avoidance as per Appendix 3 of the report; - Mitigation and enhancement measures in respect of birds; and - An implementation timetable. The works shall thereafter be carried out in accordance with the approved details and timetable. Reason - To ensure that the proposed development contributes to the conservation and enhancement of biodiversity within the site and for the wider area in accordance with paragraphs 109 and 118 of the Framework and to ensure compliance with the Wildlife and Countryside Act 1981 (as amended) and the Conservation of Habitats and Species Regulations 2010.
Before the commencement of construction works on the development hereby permitted hereby permitted a scheme of landscaping shall be submitted to and approved in writing by the Local Planning Authority. The landscaping scheme shall include:- (i) a plan(s) showing details of all existing trees and hedges on the application site. The plan should include, for each tree/hedge, the accurate position, canopy spread and species, together with an indication of any proposals for felling/pruning and any proposed changes in ground level, or other works to be carried out, within the canopy spread. (ii) a plan(s) showing the layout of proposed tree, hedge and shrub planting and grass areas. (iii) a schedule of proposed planting - indicating species, sizes at time of planting and numbers/densities of plants. (iv) a written specification outlining cultivation and other operations associated with plant and grass establishment. (v) a schedule of maintenance, including watering and the control of competitive weed growth, for a minimum period of five years from first planting. All planting and seeding/turfing shall be carried out in accordance with the approved details in the first planting and seeding/turfing seasons following the completion or first occupation/use of the development, whichever is the sooner. The planting shall be maintained in accordance with the approved schedule of maintenance. Any trees or plants which, within a period of five years from the completion of the planting, die, are removed or become seriously damaged or diseased shall be replaced in the next planting season with others of similar size and species. Reason - To ensure the proposed development does not have an adverse effect on the character and appearance of the area in accordance with policies SWDP 5, SWDP21 and SWDP25 of South Worcestershire Development Plan.
Before the first use/occupation of the development hereby permitted a plan indicating the positions, design, materials and type of boundary treatment to be erected shall be submitted to and approved in writing by the local planning authority The boundary treatment shall be completed before the first use/occupation of the development hereby permitted Development shall be carried out in accordance with the approved details. Reason - To protect the amenities of properties and ensure the proposed development does not have an adverse effect on the character and appearance of the area in accordance with policies SWDP 6, 21, 24 and 25 of South Worcestershire Development Plan..
Prior to any building works being first commenced, a precise specification of the proposed schedule of repairs for all 3 barn conversions shall be submitted to and approved in writing by the local planning authority. This shall include:- - samples of replacement brickwork; - details of any external re-pointing; - details of repairs to windows including materials and design profiles; - details of all areas of repair to the timber frame and to all structural timbers; - details of jointing methods and materials used; - methods of repair of panels and materials used. The works hereby permitted shall be carried out in accordance with the approved details. Reason: To protect, conserve and enhance the significance of heritage assets and to ensure that the new materials are in keeping with the surroundings and/or represent quality design in accordance with policies SWDP 6, SWDP21 and SWDP24 of the South Worcestershire Development Plan.
No building operations hereby permitted shall commence until details of the materials to be used in the construction of the external surfaces of the 7 dwellings hereby permitted have been submitted to and approved in writing by the local planning authority. The details to be submitted shall include:- - type, colour, texture, size, coursing, finish, jointing and pointing of brickwork/stonework; - type, colour, texture, size and design of roofing materials; - sample panel of the brickwork, type of pointing and the mortar to be used with the panel kept on site for reference; - type of mortar; - detailed specification of the new weatherboarding showing the dimensions, profile and a description of the stain or paint finish to be applied to the boarding: - details of the timber framing including joint details and methods of infilling; - external joinery details along with architectural details of the proposed external finishes, heads, sills, position in wall reveal and any surrounding dressings (elevational drawings at a minimum scale of 1:20 and vertical sectional drawings at minimum scale of 1:2); - details of the approved rooflights, including drawings showing design, materials and profile; - details of external vents, ventilation slits, extracts and chimney flues including information on specification and colour; - details of external doors/garage doors including information on finish; Reason: To protect, conserve and enhance the significance of heritage assets and to ensure that the new materials are in keeping with the surroundings and/or represent quality design in accordance with policies SWDP 6, SWDP21 and SWDP24 of the South Worcestershire Development Plan.
Notwithstanding the provisions of the Town and Country Planning (General Permitted Development) Order 2015 (as amended) (or any order revoking, re-enacting, substituting, amending, extending, consolidating, replacing or modifying that Order), no (restricted works)(additions, extensions or external alterations) (new windows or other openings) (building or enclosure, swimming or other pool required for a purpose incidental to the enjoyment of the dwelling house) [other than those expressly authorised by this permission] shall be constructed/carried out on the application site following the completion/first use of the development hereby permitted. Reason: to preserve the historic significance of the site and setting of Cooksholme Farm in accordance with SWDP 6 and 24
Prior to the first occupation of the development hereby approved a plan, schedule of implementation and management scheme for Green Infrastructure to serve the site shall be approved in writing by the Local Planning Authority. The scheme shall be implemented in accordance with the approved details. Reason - To ensure the development provides sufficient and appropriate Green Infrastructure in accordance with SWDP 5
This permission does not authorise the laying of private apparatus within the confines of the public highway. The applicant should apply to the Worcestershire County Council's Community and Response Unit, County Hall, Spetchley Road, Worcester WR5 2NP (telephone 0845 607 2005), for consent under the New Roads and Street works Act 1991 to install private apparatus within the confines of the public highway. Precise details of all works within the public highway must be agreed on site with the Highway Authority.
