Condition Details / Information Notes
The development hereby permitted shall be begun before the expiration of three years from the date of this permission. Reason: To conform with the requirements of Section 91 of the Town and Country Planning Act 1990 as amended by Section 51 of the Planning and Compulsory Purchase Act 2004.
Unless where required or allowed by other conditions attached to this permission/consent, the development hereby approved shall be carried out in accordance with the information (including details on the proposed materials) provided on the accompanying email from the applicant dated 17/11/17 and the following plans/drawings/documents – Site location plan, block plan, carriageway plan, profile view of proposed steps, proposed north face view, proposed west face view, proposed floor plan. Reason: To define the permission.
Notwithstanding the approved plans the pedestrian access between the steps and the edge of the carriageway shall be surfaced in a bound material. REASON: To ensure no loose material is carried onto the highway in the interests of highway safety.
Positive and Proactive Statement. No problems have arisen in dealing with this application. The planning application sought an acceptable form of development consistent with the requirements of relevant policies and material considerations. No amendments or alterations were therefore required and no further positive or proactive action was deemed necessary.
This permission does not authorise the construction of the proposed access structure/facility until: i. engineering details of the works within the public highway have been approved by the Highway Authority and; ii. the applicants have applied for and obtained from the County Council, as the Highway Authority, a licence under Section 115E of the Highways Act, 1980 for the construction and retention of the proposed disabled access facility within the confines of the public highway.
