Positive and Proactive Statement. In dealing with this application, the Council has worked with the applicant in the following ways:- providing pre-application advice; * - seeking further information following receipt of the application; * - seeking amendments to the proposed development following receipt of the application; * - considering the imposition of conditions and or the completion of a s.106 legal agreement* In such ways the Council has demonstrated a positive and proactive manner in seeking solutions to problems arising in relation to the planning application. This is in accordance with paragraphs 186 and 187 of the NPPF.  Despite these efforts, the Council still consider that planning permission should be refused for the reasons set out above. * delete as appropriate
This decision has been based upon the following documents and drawings: - Location plan - Block plan - PA/02 A proposed plans - PA/01 Existing plans - Structural letters dated 14/11/2017 and 02/01/2018 from Steven Holloway - Planning Statement completed by Alan McColm - Photos submitted from June 2011 - Photos submitted from 2015
The supporting evidence submitted includes internal photographs of the building from June 2011. These indicate that the main room of the building subject of this application was used to display and retail household decorative items . These items have not been produced on this horticultural holding and therefore such a use would not represent solely a agricultural use. There has been no evidence submitted to demonstrate that the use of the building changed between June 2011 and 20th March 2013. Insufficient information has been provided to demonstrate the building to which this application relates, was solely used for an agricultural use on 20 March 2013 and as such the proposed development fails ton comply with condition (a) of Class Q. As such, under the provisions of para. (3) of Class W of Part 3 of Schedule 2 of the Town and Country Planning (General Permitted Development) Order 2015 the application should be refused.
