Condition Details / Information Notes
The development hereby permitted shall be begun before the expiration of three years from the date of this permission. Reason: To conform with the requirements of Section 91 of the Town and Country Planning Act 1990 as amended by Section 51 of the Planning and Compulsory Purchase Act 2004.
Unless where required or allowed by other conditions attached to this permission, the development hereby approved shall be carried out in accordance with the information (including details on the proposed materials) provided on the application form and the following plans: 9000A Proposed Site Plan (Flood levels) 9001aA Existing Site Plan 9000 Rev P03 Proposed Filburn House type 9100 Rev P05 Proposed Hawksmoor House Type 9000A Proposed Site Plan Reason: To define the permission.
None of the properties hereby permitted shall be occupied until full details of all foul and surface water drainage systems to serve the development have been submitted to and approved in writing by the Local Planning Authority. The approved drainage works shall be implemented in accordance with the approved details before the first occupation of the development hereby permitted and shall be retained thereafter. Reason: To ensure development would not result in unacceptable risk of pollution or harm to the environment and to ensure the proposed development does not exacerbate flood risk and deals with surface water run-off from the site in a sustainable manner, in accordance with policies SWDP28, SWDP29 and SWDP 30 of the South Worcestershire Development Plan.
The application site is within 250m of a registered landfill site or significant area of unknown filled ground which has the potential to produce landfill gas from degradation processes. It is considered necessary to condition the application requiring the applicant to incorporate gas protection measures within the foundations of the proposed new structure; or to undertake a gas risk assessment to ascertain if gas protection measures are required. Consequently it is considered appropriate for the following condition to be applied to any permission granted: a) Gas protection measures complying with Characteristic Situation 2 as set out in BS8485:2015 and CIRIA C665 as a minimum requirement must be incorporated within the foundations of the proposed structure(s). Following installation of these measures, and prior to the first occupation of the development, a verification report shall be submitted to and approved in writing by the Local Planning Authority. Or b) A risk assessment should be undertaken to establish whether the proposed development is likely to be affected by landfill or ground gas or vapours. The risk assessment must be provided to and approved in writing by the Local Planning Authority, prior to the commencement of development. The assessment shall be carried out in accordance with current UK guidance and best practice. c) Where the approved risk assessment (required by condition (b) above) identifies ground gases or vapours posing unacceptable risks, no development shall commence until a detailed remediation scheme to protect the development from the effects of such ground gases or vapours has been submitted to and approved in writing by the Local Planning Authority. Following approval, the remediation scheme shall be implemented on site in complete accordance with approved details unless otherwise agreed in writing by the Local Planning Authority. d) Following implementation and completion of the approved remediation scheme (required by condition (c) above) and prior to the first occupation of the development, a verification report shall be submitted to and approved in writing by the Local Planning Authority to confirm completion of the remediation scheme in accordance with approved details. REASON: To ensure that the risk to buildings and their occupants from potential landfill or ground gases are adequately addressed.
Alteration of highway kerbing to provide new vehicle crossover. This permission does not authorise the applicant to carry out works within the publicly maintained highway. Dropped kerbs to enable access onto properties for vehicles must only be constructed by Ringway Infrastructure Services, Worcestershire County Councils approved contractor. South Worcestershire Councils Community Infrastructure Levy (Non-Strategic Allocation) The application provides residential housing within the South Worcestershire Development Plan area, therefore the South Worcestershire Councils Community Infrastructure Levy Charging Schedule is applicable. The applicant should make its proportionate contribution to identified infrastructure in accordance with the South Worcestershire Councils Community Infrastructure Levy Charging Schedule. Transport infrastructure is covered by this Levy and therefore it is essential that the cumulative impact of all development is addressed through the receipt of the contribution(s) as defined in Section 8, Table 1 of the Charging Schedule.
The dwellings hereby permitted shall not be occupied until the vehicular accesses, driveways and parking spaces shown on the approved plan have been properly consolidated, surfaced, drained and otherwise constructed in accordance with details to be submitted and approved in writing to the Local Planning Authority and these areas shall thereafter be retained and kept available for those users at all times. Reason In the interests of highway safety.
The development hereby permitted shall not begin until a Construction Environment Management Plan has been submitted to and approved in writing by the Local Planning Authority. The approved statement shall be adhered to throughout the construction period. The statement shall provide for: a) The parking of vehicles of site operatives and visitors within the application site. b) Loading and unloading of plant and materials within the application site. c) Storage of plant and materials within the application site. d) Measures to ensure that vehicles leaving the site do not deposit mud or other detritus on the public highway. e) Measures to protect the amenities of nearby properties and the highway from noise, vibration and dust during construction. Reason: To prevent indiscriminate parking in the interests of highway safety
No construction work (other than the digging of foundation trenches) on the development hereby permitted shall commenced until the precise floor slab levels of each new building, relative to the existing development on the boundary of the application site have been submitted to and approved in writing by the local planning authority. Thereafter the new buildings shall be constructed at the approved floor slab levels. Reason : To ensure the proposed development does not have an adverse effect on the character and appearance of the area in accordance with policies SWDP21 and SWDP25 of South Worcestershire Development Plan.
Demolition, clearance or construction work and deliveries to and from the site in connection with the development hereby approved shall only take place between the hours of 08.00 and 18.00hrs Monday to Friday and 08.00 and 13.00hrs on a Saturday. There shall be no demolition, clearance or construction work or deliveries to and from the site on Sundays or Bank Holidays. Reason : To preserve the amenities of the locality in accord with Policy SWDP21 of the South Worcestershire Development Plan.
Prior to the commencement of construction of any external walls or roofs of any of the dwellings hereby approved, details of the materials to be used in the construction of the external surfaces of the dwellings shall be submitted to and approved in writing by the local planning authority. The details to be submitted shall include:- - type, colour, texture, size, coursing, finish, jointing and pointing of brickwork; - type, colour, texture, size and design of roofing materials; Reason : To ensure that the new materials are in keeping with the surroundings and/or represent quality design in accordance with policy SWDP21 of the South Worcestershire Development Plan.
Before the occupation of the first property hereby approved, details of the proposed soft landscaping of the site shall be submitted to and approved in writing by the Local Planning Authority. The landscaping scheme shall include:- (i) a plan showing the layout of proposed tree, hedge and shrub planting and grass areas. (ii) a schedule of proposed planting - indicating species, sizes at time of planting and numbers/densities of plants. (iii) a written specification outlining cultivation and other operations associated with plant and grass establishment. (iv) a schedule of maintenance, including watering and the control of competitive weed growth, for a minimum period of five years from first planting. All planting and seeding/turfing shall be carried out in accordance with the approved details in the first planting and seeding/turfing seasons following the completion or first occupation of the development. The planting shall be maintained in accordance with the approved schedule of maintenance. Any trees or plants which, within a period of five years from the completion of the planting, die, are removed or become seriously damaged or diseased shall be replaced in the next planting season with others of similar size and species. Reason : To ensure the proposed development does not have an adverse effect on the character and appearance of the area in accordance with policies SWDP21 and SWDP25 of South Worcestershire Development Plan.
Prior to the occupation of any of the individual dwellings hereby permitted, renewable energy generating facilities as included within the Energy Statement dated 28/08/2018 to serve the dwelling shall be provided and fully operational. Reason: To ensure the proposed development includes sufficient renewable/low carbon energy generating facilities to comply with Policy 27 of the South Worcestershire Development Plan 2016.
Prior to the first occupation of the development hereby permitted, the details set out in the submitted Water Management Statement shall be fully implemented and remain thereafter. Reason: To ensure that an appropriate sustainable drainage system is provided to serve the development in accordance with policy SWDP29 of the South Worcestershire Development Plan 2016.
Positive and Proactive Statement. In dealing with this application, the Council has worked with the applicant in the following ways: - seeking further information following receipt of the application; - seeking amendments to the proposed development following receipt of the application; - considering the imposition of conditions and or the completion of a s.106 legal agreement. In such ways the Council has demonstrated a positive and proactive manner in seeking solutions to problems arising in relation to the planning application.
(A) No development shall take place until a programme of archaeological work, including a Written Scheme of Investigation, has been submitted to and approved by the local planning authority in writing. The scheme shall include an assessment of significance and research questions; and: 1) The programme and methodology of site investigation and recording. 2) The programme for post investigation assessment. 3) Provision to be made for analysis of the site investigation and recording. 4) Provision to be made for publication and dissemination of the analysis and records of the site investigation. 5) Provision to be made for archive deposition of the analysis and records of the site investigation. 6) Nomination of a competent person or persons/organisation to undertake the works set out within the Written Scheme of Investigation. (B) The development shall not be occupied until the site investigation and post investigation assessment has been completed in accordance with the programme set out in the Written Scheme of Investigation approved under condition (A) and the provision made for analysis, publication and dissemination of results and archive deposition has been secured. Reason: In accordance with the requirements of paragraphs 189 and 199 of the National Planning Policy Framework 2012 (as revised July 2018).
