Wychavon District Council, of The Civic Centre, Queen Elizabeth Drive, Pershore, Worcestershire WR10 1PT HEREBY CERTIFY that application reference 19/00155/CLPU registered on 7th February 2019 for a Certificate of Lawfulness Proposed Use or Development is REFUSED in relation to the matter described in the First Schedule to this Notice in respect of the land specified in the Second Schedule to this Notice and on the plan attached to this Notice, as the matter described in the First Schedule to this Notice would not be lawful as at the 7th February 2019 within the meaning of section 192 of the Town and Country Planning Act (as amended), for the following reason(s) :- The proposal would not comply with clause A.1 (f) (or (g)) and clause (j) of Class A, Part 1, Schedule 2 of the Town and Country Planning (General Permitted Development Order (GPDO)) 2015 in that the extension would (i) extend more than 3 metres from the rear wall of the garage and (ii) extend beyond a wall forming a side elevation of the original house and have a width more than half the width of the original house. As such, the proposal fails to represent permitted development and cannot to benefit from the permission granted by the GPDO. As such the proposed development is not lawful.
