Condition Details / Information Notes
The development hereby permitted shall be begun before the expiration of three years from the date of this permission. Reason: To conform with the requirements of Section 91 of the Town and Country Planning Act 1990 as amended by Section 51 of the Planning and Compulsory Purchase Act 2004.
Prior to the first use/occupation of the development hereby permitted, the details set out in the submitted Water Management Statement shall be fully implemented and remain thereafter. Reason: To ensure that an appropriate sustainable drainage system is provided to serve the development in accordance with policy SWDP29 of the South Worcestershire Development Plan.
Before the first use/occupation of the development hereby permitted a scheme of landscaping shall be submitted to and approved in writing by the Local Planning Authority. The landscaping scheme shall include:- (i) a plan(s) showing details of all existing trees and hedges on the application site. The plan should include, for each tree/hedge, the accurate position, canopy spread and species, together with an indication of any proposals for felling/pruning and any proposed changes in ground level, or other works to be carried out, within the canopy spread. (ii) a plan(s) showing the layout of proposed tree, hedge and shrub planting and grass areas. (iii) a schedule of proposed planting - indicating species, sizes at time of planting and numbers/densities of plants. (iv) a written specification outlining cultivation and other operations associated with plant and grass establishment. (v) a schedule of maintenance, including watering and the control of competitive weed growth, for a minimum period of five years from first planting. All planting and seeding/turfing shall be carried out in accordance with the approved details in the first planting and seeding/turfing seasons following the completion or first occupation/use of the development, whichever is the sooner. The planting shall be maintained in accordance with the approved schedule of maintenance. Any trees or plants which, within a period of five years from the completion of the planting, die, are removed or become seriously damaged or diseased shall be replaced in the next planting season with others of similar size and species. Reason - To (i) ensure the proposed development does not have an adverse effect on the character and appearance of the area in accordance with policies SWDP21 and SWDP25 of the South Worcestershire Development Plan, and (ii) ensure compliance with the Wildlife and Countryside Act 1981 (as amended) and the Conservation of Habitats and Species Regulations 2017 and in accordance with policy SWDP22 of the South Worcestershire Development Plan.
The development hereby permitted shall be carried out in strict accordance with the recommendations set out in the Preliminary Ecological Appraisal by Focus Ecology dated June 2019 and submitted with this application. In particular: - inspection of trees with low bat roost potential by a suitably licensed bat ecologist prior to them being felled; - creation of deadwood habitat from felled trees; - ensuring that nesting birds are not disturbed during clearance works; - enhancement for bats and birds through the provision of bat and bird boxes; and - avoidance / careful control of external lighting. Details of the type and location of the chosen bat box and bird boxes and the deadwood habitat shall be submitted to and approved in writing prior to the commencement of the development. The approved features shall be installed prior to the development hereby permitted first being occupied/used. On completion of works the development shall be inspected by a qualified ecologist and a statement of conformity shall be submitted to the Local Planning Authority to confirm whether all of the biodiversity mitigation and enhancement measures have been implemented in accordance with the details approved under this condition. Reason: To ensure the development contributes to the conservation and enhancement of biodiversity within the site and the wider area in accordance with policy SWDP22 of the South Worcestershire Development Plan and to ensure compliance with the Wildlife and Countryside Act 1981 (as amended) and the Conservation of Habitats and Species Regulations 2017.
Before installation on site, details of any external lighting shall be submitted to and approved in writing by the Local Planning Authority. The details shall include times when the external lighting will not be switched on. Only lighting so approved shall be installed on site. The lighting should be designed so that it is directed as far as possible towards/within the application site with minimal spillage beyond the confines of the site. Reason - To (i) ensure the proposed development does not have an adverse effect on the character and appearance of the area in accordance with policies SWDP1, SWDP21 and SWDP25 of South Worcestershire Development Plan and (ii) ensure the development contributes to the conservation and enhancement of biodiversity within the site and the wider area in accordance with policy SWDP22 of the South Worcestershire Development Plan.
The development hereby permitted shall not be occupied/first used until full details of all foul and surface water drainage systems to serve the development have been submitted to and approved in writing by the Local Planning Authority. The approved drainage works shall be implemented in accordance with the approved details before the first occupation/use of the development hereby permitted and shall be retained thereafter. Reason: To ensure development would not result in unacceptable risk of pollution or harm to the environment and to ensure the proposed development does not exacerbate flood risk and deals with surface water run-off from the site in a sustainable manner, in accordance with policies SWDP28, SWDP29 and SWDP30 of the South Worcestershire Development Plan.
Before any access roads, turning areas and parking spaces other than those shown on the Zebra drawing number L-011 - Existing Site Layout are constructed, details of their consolidation, surfacing and drainage shall be submitted to and approved in writing by the Local Planning Authority. The access roads, turning areas and parking spaces shall be constructed in accordance with the approved details and thereafter be retained and kept available for those uses at all times. Reason - In the interests of pedestrian and parking safety in accordance with policy SWDP21 of the South Worcestershire Development Plan.
There shall be no more than 52 static caravans placed on the application site at any one time including the warden’s caravan and they shall be laid out in accordance with the approved Zebra drawing number L-010 - Proposed Layout Plan. No caravans (either static or touring) shall be used or stored on any other part of the site including the area marked as “recreation area” on drawing number L-010 thereafter. Any caravan positioned on the site shall meet the definition of a caravan as set out in section 29 of the Caravan Sites and Control of Development Act 1960 and section 13 of the Caravan Sites Act 1968. Reason - To (i) define the permission hereby granted and to ensure the appearance of the site is satisfactory and causes no harm to the visual amenities of the area in line with policies SWDP25 and SWDP36 of the South Worcestershire Development Plan, and (ii) ensure that the number of caravans on the site does not increase and to prevent the encroachment of the caravan site onto the River Avon floodplain in accordance with policies SWDP28 and SWDP36 of the South Worcestershire Development Plan.
With the exception of the warden’s caravan shown on the approved 1: 500 scale Layout Plan, this permission only allows the use of the site for the siting of static caravans for holiday use only. None of the units provided on the site shall be used as permanent residential accommodation or occupied as a person's sole, or main place of, residence with the exception of the warden’s caravan which shall only be occupied by the warden of the caravan site hereby approved and their dependents. Reason - The provision of permanent dwellings on this site would be contrary to development plan policies SWDP2 and SWDP19 directing most new housing to urban areas and other sustainable locations.
Before any static caravan other than those shown on the Zebra drawing number L-011 - Existing Site Layout is positioned on the site, details of its external colour shall be submitted to and approved in writing by the Local Planning Authority and shall be retained in that form thereafter. Reason: To ensure that the proposal is visually acceptable in accordance with polices SWDP36 and SWDP25 of the Development Plan.
Before any static caravan other than those shown on the Zebra drawing number L-011 - Existing Site Layout is positioned on the site, details of a Welcome Pack promoting sustainable forms of access to the development shall be submitted to and approved in writing by the Local Planning Authority. Thereafter, a copy of the Welcome Pack shall be provided to each static caravan occupier of caravans other than those shown on the Zebra drawing number L-011 - Existing Site Layout. Reason: To reduce vehicle movements and promote sustainable access in accordance with policy SWDP21 of the South Worcestershire Development Plan.
Unless where required or allowed by other conditions attached to this permission/consent, the development hereby approved shall be carried out in accordance with the information (including details on the proposed materials) provided on the application form and the following plans/drawings/documents – Promap 1:2500 scale Location Plan; Zebra Architects drawing numbers L-010 and L-011 Reason: To define the permission.
Positive and Proactive Statement. In dealing with this application, the Council has worked with the applicant in the following ways: - seeking further information following receipt of the application; - seeking amendments to the proposed development following receipt of the application; and - considering the imposition of conditions. In such ways the Council has demonstrated a positive and proactive manner in seeking solutions to problems arising in relation to the planning application.
