Condition Details / Information Notes
The development hereby permitted shall be begun before the expiration of three years from the date of this permission. Reason: To conform with the requirements of Section 91 of the Town and Country Planning Act 1990 as amended by Section 51 of the Planning and Compulsory Purchase Act 2004.
The development shall not commence until details of the surface materials for the access have been submitted to and approved in writing by the Local Planning Authority. Reason: To ensure the materials are in the rural landscape in accordance with Policy SWDP25 of the Soputh Worcestershire Development Plan.
Before the commencement of construction works on the development hereby permitted a scheme of boundary landscaping shall be submitted to and approved in writing by the Local Planning Authority. The landscaping scheme shall include:- (i) a plan showing the layout of proposed tree, hedge and shrub planting to the fenced boundaries surrounding the access. (ii) a schedule of proposed planting - indicating species, sizes at time of planting and numbers/densities of plants. (iii) a written specification outlining cultivation and other operations associated with plant establishment. (iv) a schedule of maintenance, including watering and the control of competitive weed growth, for a minimum period of five years from first planting. All planting shall be carried out in accordance with the approved details in the first planting season following the completion of the development.The planting shall be maintained in accordance with the approved schedule of maintenance. Any trees or plants which, within a period of five years from the completion of the planting, die, are removed or become seriously damaged or diseased shall be replaced in the next planting season with others of similar size and species. Reason - To ensure the proposed development does not have an adverse effect on the character and appearance of the area in accordance with policies SWDP21 and SWDP25 of South Worcestershire Development Plan.
Unless where required or allowed by other conditions attached to this permission/consent, the development hereby approved shall be carried out in accordance with the information (including details on the proposed materials) provided on the application form and the following plans – 225-A Site plan 113 Location plan 354 Gates to field elevation 355-A gates to field plan Reason: To define the permission.
Positive and Proactive Statement. In dealing with this application, the Council has worked with the applicant in the following ways:- - seeking further information following receipt of the application; - seeking amendments to the proposed development following receipt of the application; - considering the imposition of conditions and or the completion of a s.106 legal agreement. In such ways the Council has demonstrated a positive and proactive manner in seeking solutions to problems arising in relation to the planning application.
No other part of the development hereby permitted shall commence until the visibility splays shown on the approved plans have been provided. The splays shall at all times be maintained free of level obstruction exceeding a height of 0.6m above adjacent carriageway. Reason - In the interests of highway safety.
The existing vehicular access onto the adjoining highway shall be permanently closed within 28 days of the new access having been provided. Details of the means of closure and reinstatement of this existing access shall be submitted to and approved in writing by the Local Planning Authority prior to the commencement of work on the development hereby approved. Reason - To ensure the safe and free flow of traffic using the adjoining County highway.
The development hereby permitted shall not be brought into use until the access shown on drawings 13-714 225 rev A and 13-714 355 rev A has been constructed in accordance with the details shown thereon and once provided the access shall thereafter be retained and maintained in accordance with those details at all times. Reason - In the interests of highway safety and to ensure the free flow of traffic using the adjoining highway.
