Condition Details / Information Notes
The application site is located in an isolated location away from the nearest settlements of Eckington and Bredons Norton. The site lies in open countryside as defined under policy SWDP2 of the South Worcestershire Development Plan 2016. Furthermore, due to the distance between the site and Eckington, the lack of frequent bus services serving the site as well as lack of footway/street lighting, journeys to and from the residential element of the proposal will be largely dependent upon private car as mode of travel. The South Worcestershire Development Plan policy 17 is specifically related to gypsy and traveller development. The policy looks to direct gypsy and traveller sites to within or on the edge of a town or Category 1,2 or 3 settlement where the need to travel to facilities and services is reduced. The National Planning Policy Framework (the Framework) identifies one of the core principles of the planning system as recognising the intrinsic character and beauty of the countryside. The Framework advises that its content should be read in conjunction with the DCLG Planning Policy for Traveller Sites (PPTS). Paragraph 4 of the PPTS includes the government aims in respect of traveller sites. These aims include increasing the provision of traveller sites in appropriate locations and from which travellers can access education, health, welfare and employment infrastructure. Policy H of the PPTS advises at paragraph 25 that new gypsy and traveller development should be very strictly limited in open countryside that is away from existing settlements or outside areas allocated in the development plan. . Due to the site being located in the open countryside away from the nearest settlement and services, the proposed development would be contrary to the stated policies from the South Worcestershire Development Plan as well as the policies and guidance of the NPPF and the PPTS. Whilst noting the personal circumstances of with the applicant as well as the shortage of traveller sites in the district at the current time, it is felt that the proposal fails to represent sustainable development and the benefits of the scheme are clearly outweighed by the disadvantages.. The proposal is considered to be contrary to Policies SWDP2 and SWDP17 of the south Worcestershire Development Plan, and Policy H of the Planning Policy for Traveller Sites, in particular paragraphs 23 and 25 and paragraph 14 and 17 of the national Planning Policy Framework.
Whilst there are no formal highway objections to the proposal, concern has been expressed about the maintenance of the visibility splay. The roadside hedge is located on land outside of the ownership of the applicant and as such there is no guarantee that the visibility splay can be maintained by the applicant. The Council raises no formal objection to the application on the basis of inadequate visibility splays, however this is on the basis that a condition requiring clear visibility across these splays can be properly imposed.
The residential use of the site hereby permitted shall not begin until details of the foul and surface water drainage system to serve the development have been submitted to and approved in writing by the Local Planning Authority. The approved drainage system shall be provided prior to the first residential use of the site.
The use of the paddock for the grazing of animals shall not begin until there has be erected around the paddock, and along the western boundary of the site on land adjacent to the railway line, a 1.8m stockproof fence the details of which shall have been submitted to and approved in writing by the Local Planning Authority. The fence thereafter shall be maintained and kept stock-proof at all times.
No construction works on the utility and/or stable block hereby permitted shall be commenced until details of the materials to be used in the construction of the external walls and roofs have been submitted to and approved in writing by the Local Planning Authority. The development shall be carried out in accordance with the approved details.
No part of the development shall be commenced until full details of soft landscaping works to be provided on the site have been submitted to and approved in writing by the Local Planning Authority. The details submitted must include: a plan showing details of all existing trees and hedges on the application site. The plan should include, for each tree/hedge, the accurate position, canopy spread and species, together with an indication of any proposals for felling/pruning and any proposed changes in ground level, or other works to be carried out, within the canopy spread. a plan showing the layout of proposed tree, hedge and shrub planting and grass areas. a schedule of proposed planting - indicating species, sizes at time of planting and numbers/densities of plants. a written specification outlining cultivation and other operations associated with plant and grass establishment. a schedule of maintenance, including watering and the control of competitive weed growth, for a minimum period of five years from first planting. All planting and seeding/turfing shall be carried out in accordance with the approved details in the first planting and seeding/turfing seasons following the completion or first occupation/use of the development, whichever is the sooner. Any trees or plants which, within a period of five years from the completion of the planting, die, are removed or become seriously damaged or diseased shall be replaced in the next planting season with others of similar size and species, unless otherwise agreed in writing by the Local Planning Authority.
No external lighting shall be installed on the site other than in accordance with details that have previously been submitted to and approved in writing by the Local Planning Authority.
No gates are to be erected at the site entrance onto the B4080, or within 10m of it, other than in accordance with details that have previously been submitted to and approved in writing by the Local Planning Authority.
