Condition Details / Information Notes
The development hereby permitted shall be begun before the expiration of three years from the date of this permission. Reason: To conform with the requirements of Section 91 of the Town and Country Planning Act 1990 as amended by Section 51 of the Planning and Compulsory Purchase Act 2004.
Unless where required or allowed by other conditions attached to this permission, the development hereby approved shall be carried out in accordance with the information (including details on the proposed materials) provided on the application form and the following plans/drawings/documents – 2018-42-01 2018-42-02 Proposed Block Plan 1:500 Location Plan 1:1250 Reason: To define the permission.
Prior to commencement of any works relating to the new vehicular access hereby permitted a programme of archaeological work, including a Written Scheme of Investigation, shall be submitted to and approved by the local planning authority in writing. The scheme shall include an assessment of significance and research questions; and: a. The programme and methodology of site investigation and recording. b. The programme for post investigation assessment. c. Provision to be made for analysis of the site investigation and recording. d. Provision to be made for publication and dissemination of the analysis and records of the site investigation e. Provision to be made for archive deposition of the analysis and records of the site investigation f. Nomination of a competent person or persons/organisation to undertake the works set out within the Written Scheme of Investigation. No demolition/development shall take place other than in accordance with the Written Scheme of Investigation. The development shall not be brought into use until the site investigation and post investigation assessment has been completed in accordance with the programme set out in the Written Scheme of Investigation and the provision made for analysis, publication and dissemination of results and archive deposition has been secured. Reason: To protect, conserve and enhance the significance of heritage assets in accordance with Policies SWDP 6 and SWDP 24 of the South Worcestershire Development Plan.
Before the first use of the new access driveway hereby permitted a scheme of landscaping, in compensation for the trees and hedgerow to be lost, shall be submitted to and approved in writing by the Local Planning Authority. The landscaping scheme shall include:- (i) a plan(s) showing details of existing trees and hedges on the application site. The plan should include, for each tree/hedge, the accurate position, canopy spread and species, together with an indication of any proposals for felling/pruning and any proposed changes in ground level, or other works to be carried out, within the canopy spread. (ii) a plan(s) showing the layout of proposed tree, hedge and shrub planting. (iii) a schedule of proposed planting - indicating species, sizes at time of planting and numbers/densities of plants. (iv) a written specification outlining cultivation and other operations associated with plant and grass establishment. (v) a schedule of maintenance, including watering and the control of competitive weed growth, for a minimum period of five years from first planting. All planting and seeding/turfing shall be carried out in accordance with the approved details in the first planting and seeding seasons following the completion of the development. The planting shall be maintained in accordance with the approved schedule of maintenance. Any trees or plants which, within a period of five years from the completion of the planting, die, are removed or become seriously damaged or diseased shall be replaced in the next planting season with others of similar size and species. Reason: To ensure the proposed development does not have an adverse effect on the character and appearance of the area in accordance with Policies SWDP 21 and SWDP 25 of South Worcestershire Development Plan.
Prior to the laying out and construction of the new access hereby approved, a Construction Environmental Management Plan shall be submitted to and approved in writing by the local planning authority. This shall include the following:- a) Measures to ensure that vehicles leaving the site do not deposit mud or other detritus on the public highway; and b) Details of site operative parking areas, material storage areas and the location of site operative facilities. The measures set out in the approved plan shall be carried out in full during the construction of the development hereby approved. Site operatives’ parking, material storage and the positioning of operatives’ facilities shall only take place on the site in locations approved in writing by the local planning authority. Reason: In the interests of highway safety.
Before any construction works on the new access hereby permitted is commenced, a specification for the new point shall be submitted to and approved in writing by the Local Planning Authority. The access shall be at a gradient not steeper than 1 in 20. The new access shall be constructed in accordance with the approved specification. Reason: In the interests of highway safety.
The access hereby permitted shall be constructed so there is clear visibility from a point 0.6m above the level of the adjoining carriageway at the centre of the access 2.4 metres from and parallel to the entire length of the site frontage. Nothing shall be planted, erected and/or allowed to grow on the area of land so formed which would obstruct the visibility described above and these areas shall thereafter be retained and kept available for visibility purposes at all times. Reason: In the interests of highway safety.
Notwithstanding the details as shown on the approved plans, the new entrance shall be set back 5 metres from the rear of the adjoining footway. On each side of the set back entrance, splays shall be formed at an angle of 45 degrees with the highway boundary and the whole of the splayed areas shall be graded and cleared so that no part thereof exceeds a height of 0.6m above the relative level of the adjoining carriageway. Reason: In the interests of highway safety.
Prior to the first use of the development hereby permitted, the details set out in the submitted Water Management Statement shall be fully implemented and remain thereafter. Reason: To ensure that an appropriate sustainable drainage system is provided to serve the development in accordance with Policy SWDP 29 of the South Worcestershire Development Plan.
Positive and Proactive Statement. In dealing with this application, the Council has worked with the applicant by seeking further information and amendments to the proposed development following receipt of the application, as well as considering the imposition of conditions. In such ways the Council has demonstrated a positive and proactive manner in seeking solutions to problems arising in relation to the planning application.
Severn Trent Water has advised that there may be a public sewer located within the application site. Although statutory sewer records do not show any public sewers within the area specified, there may be sewers that have been recently adopted under the Transfer Of Sewer Regulations 2011. Public sewers have statutory protection and may not be built close to, directly over or be diverted without consent and contact should be made with Severn Trent Water to discuss the proposals.
This permission does not authorise the applicant to carry out works within the publicly maintained highway. Dropped kerbs to enable access onto properties for vehicles must only be constructed by Ringway Infrastructure Services, Worcestershire County Councils approved contractor. Work should avoid disturbance to nesting birds. Nesting birds are protected under the 1981 Wildlife and Countryside Act and the Countryside and Rights of Way Act 2000. The main nesting season lasts approximately from March to September, so work should take place outside these dates if at all possible. However, birds can nest at any time and the site including any hedgerows and trees should ideally be checked for their presence immediately before work starts.
