Condition Details / Information Notes
The site lies within the Cleeve Prior Bank Local Wildlife Site and immediately adjacent to the River Avon LWS. Both of these sites are important linear corridors and are of high value for wildlife. The proposed development would cause significant harm to the Cleeve Prior Bank LWS by: - significantly reducing the width of the wildlife corridor; and - the lack of suitable compensatory habitat for that lost. The harm caused by the habitat loss outweighs the benefits of the proposed development. In addition, there is insufficient information to demonstrate: - the pollution effects from the scheme (including runoff, noise and light pollution) and the risk of adverse impact of these, in particular on the River Avon LWS and species using the river corridor, have been taken into account and can be adequately mitigated against; - the presence of reptiles has been fully considered due to the date the Preliminary Ecological Appraisal was carried out; and - the extent and impact of works to site the cabins on the fairly steeply sloping site. In these ways the proposal is contrary to paragraph 99 of ODPM Circular 06/2005, paragraphs 109 and 118 of the Framework, as well as policies SWDP22, SWDP30 and SWDP31 of the adopted South Worcestershire Development Plan 2016.
The use of the long, narrow, steep-sided and rough steeply graded length of Mill Lane, together with the lack of passing bays from its junction with Mill Lane adjacent to Rivermill House and Priorsleigh to the proposed driveway is an unsafe and unsuitable means of access to serve the proposed development and is likely to compromise the safe movement of vehicles and pedestrians and the safe use of the roadway by others. In addition, the identified section of Mill Lane from its junction with Rivermill House and Priorsleigh is unsuitable by reason of width, condition and gradient to serve refuse and servicing vehicles, together with construction traffic. In these ways the proposal is contrary to the interests of highway safety and contrary to Policy SWDP21and Policy SWDP36 v of the South Worcestershire Development Plan 2016 and advice in the Framework (paragraph 32).
The following plans are relevant to this decision: 1:1250 scale Location Plan; 1:500 scale Block Plan; Pinelog elevations/floorplans;
Positive and Proactive Statement In dealing with this application, the Council has worked with the applicant in the following ways:- - providing pre-application advice; - seeking further information following receipt of the application; and - considering the imposition of conditions. In such ways the Council has demonstrated a positive and proactive manner in seeking solutions to problems arising in relation to the planning application. This is in accordance with paragraphs 186 and 187 of the NPPF. Despite these efforts, the Council still consider that planning permission should be refused for the reasons set out above.
