Condition Details / Information Notes
The development hereby permitted shall be begun before the expiration of three years from the date of this permission. Reason: To conform with the requirements of Section 91 of the Town and Country Planning Act 1990 as amended by Section 51 of the Planning and Compulsory Purchase Act 2004.
Unless where required or allowed by other conditions attached to this permission/consent, the development hereby approved shall be carried out in accordance with the information (including details on the proposed materials) provided on the application form and the following plans/drawings/documents – Ki 4977 24 location plan Ki 4977 37 staircase details Ki 4977 36A joinery details Ki 4977 35 timber frame plan Ki 4977 33 proposed block plan Ki 4977 32A proposed site plan Ki 4977 31A proposed elevations Ki 4977 30 proposed floorplans Reason: To define the permission.
Prior to any building works being first commenced, a precise specification of the proposed schedule of repairs shall be submitted to and approved in writing by the local planning authority. This shall include:- - samples of replacement brickwork or stone; - details of any external re-pointing; - details of all areas of repair to the timber frame and to all structural timbers; - details of jointing methods and materials used; - methods of repair of panels and materials used. The works hereby permitted shall be carried out in accordance with the approved details. Reason: To protect, conserve and enhance the significance of heritage assets and to ensure that the new materials are in keeping with the surroundings and/or represent quality design in accordance with policies SWDP 6, SWDP21 and SWDP24 of the South Worcestershire Development Plan.
No building operations hereby permitted shall commence until details of the materials to be used in the construction of the barn conversion hereby permitted have been submitted to and approved in writing by the local planning authority. The details to be submitted shall include:- - type, colour, texture, size and design of any new roofing materials; - detailed specification of any new weatherboarding showing the dimensions, profile and a description of the stain or paint finish to be applied to the boarding: - details of the approved rooflights, including drawings showing design, materials and profile; - details of external vents, ventilation slits, extracts and chimney flues including information on specification and colour; - specification of the proposed flooring The development shall be carried out using the materials as approved. Reason: To protect, conserve and enhance the significance of heritage assets and to ensure that the new materials are in keeping with the surroundings and/or represent quality design in accordance with policies SWDP 6, SWDP21 and SWDP24 of the South Worcestershire Development Plan.
Prior to their installation as part of the development hereby approved, details of the following shall be submitted to and approved in writing by the local planning authority:- - detailed schedule of thermal and sound insulation for the building; - details of new and/or relocated soil and vent pipes with their connecting waste pipes; - details of the proposed plaster mix, surface finish and method of fixing to the wall - details of any proposed internal block work walls and their connection to existing timber frame The development shall be carried out using the materials as approved. Reason: To protect, conserve and enhance the significance of heritage assets and to ensure that the new materials are in keeping with the surroundings and/or represent quality design in accordance with policies SWDP 6, SWDP21 and SWDP24 of the South Worcestershire Development Plan.
Before the first use/occupation of the development hereby permitted a plan indicating the positions, design, materials and type of boundary treatment to be erected and ppanted shall be submitted to and approved in writing by the local planning authority The boundary treatment shall be completed before the first use/occupation of the development hereby permitted. Development shall be carried out in accordance with the approved details. Reason - To protect, conserve and enhance the significance of heritage assets and to ensure that the new materials and planting are in keeping with the surroundings and/or represent quality design in accordance with policies SWDP 6, SWDP21 and SWDP24 of the South Worcestershire Development Plan.
The development hereby permitted shall not be occupied/first used until full details of all foul and surface water drainage systems to serve the development have been submitted to and approved in writing by the Local Planning Authority. The approved drainage works shall be implemented in accordance with the approved details before the first occupation/use of the development hereby permitted and shall be retained thereafter. Reason: To ensure development would not result in unacceptable risk of pollution or harm to the environment and to ensure the proposed development does not exacerbate flood risk and deals with surface water run-off from the site in a sustainable manner, in accordance with policies SWDP28, SWDP29 and SWDP 30 of the South Worcestershire Development Plan.
Before the commencement of the development hereby approved an ecological mitigation and enhancement scheme has been drawn up by a suitably qualified ecologist, shall be submitted to and approved in writing by the local planning authority. The scheme shall be based on the recommendations contained within the Bat Survey Report by Focus Ecology dated December 2016 and shall include an implementation timetable. The works shall thereafter be carried out in accordance with the approved details and timetable. On completion a brief statement of conformity shall be submitted to the local planning authority for information. Reason - To ensure that the proposed development contributes to the conservation and enhancement of biodiversity within the site and for the wider area in accordance with policy SWDP22 of the South Worcestershire Development Plan and to ensure compliance with the Wildlife and Countryside Act 1981 (as amended) and the Conservation of Habitats and Species Regulations 2010.
No development shall take place until a programme of archaeological work, including a Written Scheme of Investigation, has been submitted to and approved by the local planning authority in writing. The scheme shall include an assessment of significance and research questions; and: 1) The programme and methodology of site investigation and recording. 2) The programme for post investigation assessment. 3) Provision to be made for analysis of the site investigation and recording. 4) Provision to be made for publication and dissemination of the analysis and records of the site investigation. 5) Provision to be made for archive deposition of the analysis and records of the site investigation. 6) Nomination of a competent person or persons/organisation to undertake the works set out within the Written Scheme of Investigation. The development shall not be occupied until the site investigation and post investigation assessment has been completed in accordance with the programme set out in the Written Scheme of Investigation approved under condition (A) and the provision made for analysis, publication and dissemination of results and archive deposition has been secured. Reason - To protect and conserve the significance of archaeological heritage assets in accordance with policies SWDP 6 and SWDP24 of the South Worcestershire Development Plan.
Notwithstanding the approved plans before any other works hereby approved are commenced, visibility splays shall be provided from a point 0.6m above ground level at the centre of the access to the application site and 2.4 metres back from the near side edge of the adjoining carriageway, (measured perpendicularly), for a distance of 50 metres in each direction measured along the nearside edge of the adjoining carriageway. Nothing shall be planted, erected and/or allowed to grow on the triangular area of land so formed which would obstruct the visibility described above. Reason - In the interests of highway safety.
Notwithstanding the approved drawings for its first 5.0 metre length measured back from the edge of the carriageway the site access shall have a width of 5.0 metres and be surfaced in a bound material. The verge crossing shall be set out and constructed as a splayed crossing and not with radii as shown on the application plans. Reason - In the interests of highway safety.
The development hereby permitted shall not be brought into use until the access, turning area and parking facilities shown on the approved plan have been provided and these areas shall thereafter be retained and kept available for those users at all times. Reason - In the interests of highway safety and to ensure the free flow of traffic using the adjoining highway.
Notwithstanding the provisions of the Town and Country Planning (General Permitted Development) Order 2015 (as amended) (or any order revoking, re-enacting, substituting, amending, extending, consolidating, replacing or modifying that Order), no (restricted works)(additions, extensions or external alterations) (new windows or other openings) (building or enclosure, swimming or other pool required for a purpose incidental to the enjoyment of the dwelling house) [other than those expressly authorised by this permission] shall be constructed/carried out on the application site following the completion/first use of the development hereby permitted. Reason - To protect and conserve the significance of heritage assets in accordance with policies SWDP 6, SWDP21 and SWDP24 of the South Worcestershire Development Plan.
The applicant must be aware of their obligations towards the public right of way as follows: No disturbance of, or change to, the surface of the path or part thereof should be carried out with written consent (this includes laying concrete, tarmac or similar) No diminution in the width of the right of way available for use by the public. Building materials must not be stored on the right of way. Vehicle movements and parking to be arranged so as not to unreasonably interfere with the public's use of the right of way. No additional barriers are placed across the right of way. No stile, gate, fence or other structure should be created on, or across, a public right of way without written consent of the Highway Authority. The safety of the public using the right of way is to be ensure at all times.
The development shall be undertaken in accordance with the guidance outlined within the Linewatch manual entitled spaecial requirements for safe working in close proximity to high pressure pippelines revision 17.06
The attention of the applicant is drawn to the need to keep the highway free from any mud or other material emanating from the application site or any works pertaining thereto.
This permission does not authorise the laying of private apparatus within the confines of the public highway. The applicant should apply to the Worcestershire County Council's Community and Response Unit, County Hall, Spetchley Road, Worcester WR5 2NP (telephone 0845 607 2005), for consent under the New Roads and Street works Act 1991 to install private apparatus within the confines of the public highway. Precise details of all works within the public highway must be agreed on site with the Highway Authority.
Positive and Proactive Statement. In dealing with this application, the Council has worked with the applicant in the following ways:- providing pre-application advice; - seeking further information following receipt of the application; - seeking amendments to the proposed development following receipt of the application; - considering the imposition of conditions. In such ways the Council has demonstrated a positive and proactive manner in seeking solutions to problems arising in relation to the planning application.
