Condition Details / Information Notes
The development hereby permitted shall be begun before the expiration of three years from the date of this permission. Reason: To conform with the requirements of Section 91 of the Town and Country Planning Act 1990 as amended by Section 51 of the Planning and Compulsory Purchase Act 2004.
Unless where required or allowed by other conditions attached to this permission/consent, the development hereby approved shall be carried out in accordance with the information (including details on the proposed materials) provided on the application form and the following plans/drawings/documents – GLA 756 100 Site location plan, 101 Location plan, 104 Block Plan Proposed, 002 B Tree Retention, 003 G, 004 Tree Protection Plan, 005 A Planting plan. Reason: To define the permission.
Prior to the first use of the development hereby permitted, the details set out in the submitted Water Management Statement shall be fully implemented and remain thereafter. Reason: To ensure that an appropriate sustainable drainage system is provided to serve the development in accordance with policy SWDP29 of the South Worcestershire Development Plan 2016.
No part of the development hereby permitted shall begin until a Construction Management Plan for both demolition and construction phases to include details of: a. Parking for site operatives and visitors b. Area for site operatives' facilities c. Parking and turning for delivery vehicles d. Areas for the storage of plant and materials e. Wheel washing equipment f. Boundary hoarding (set back behind any visibility splays) has been submitted to, and approved in writing by, the Local Planning Authority. Only the approved Plan shall be implemented throughout the construction period. Reason - To ensure the provision of adequate on-site facilities and in the interests of highway safety.
No part of the upgraded facilities within the public open space shall be brought into use until the visibility splays at the pedestrian crossing on Woodbury Close shown on the approved plans have been provided. The splays shall at all times be maintained free of obstruction exceeding a height of 0.6m above adjacent carriageway level. Reason - In the interests of highway safety.
No part of the upgraded facilities within the public open space shall be brought into use until the pedestrian crossing on Woodbury Close shown on the approved plans, to include all ancillary works, has been provided and constructed in accordance with details that have been submitted to, and approved in writing by, the Local Planning Authority. Once provided the crossing shall thereafter be retained and maintained for that purpose at all times. Reason - In the interests of highway safety.
No part of the upgraded facilities within the public open space shall be brought into use until the accesses, turning areas and parking facilities shown on the approved plan have been provided and these areas shall thereafter be retained and kept available for those users at all times. Reason - In the interests of highway safety and to ensure the free flow of traffic using the adjoining highway.
All planting and seeding/turfing comprised in the submitted landscape scheme, hereby approved, shall be carried out in the first planting season following the first occupation/use of the development. All planting shall be watered as necessary and competitive weed growth controlled to ensure successful establishment. Any trees or plants that die, or are removed; or become seriously damaged or diseased within a period of five years from the completion of the planting, shall be replaced in the next planting season with others of similar size and species. Reason: To ensure the proposed development does not have an adverse effect on the character and appearance of the area in accordance with policies SWDP21 and SWDP25 of South Worcestershire Development Plan 2016.
Before the first use of the development hereby permitted a schedule of landscape maintenance for a minimum period of 10 years submitted to and approved in writing by the local planning authority. The schedule shall include details of the arrangements for its implementation, long-term design objectives, management responsibilities and maintenance schedules for all landscape areas . The approved landscape maintenance schedule shall be fully implemented. Reason - To ensure the proposed development does not have an adverse effect on the character and appearance of the area in accordance with policies SWDP21 and SWDP25 of South Worcestershire Development Plan.
The development hereby permitted shall be carried out in strict accordance with the recommendations set out in the Preliminary Ecological Appraisal & Bat Survey report carried out Sharpe Ecology, 31 Worcester Road, Pershore dated August 2017 and submitted with this application. Reason: To ensure the development contributes to the conservation and enhancement of biodiversity within the site and the wider area in accordance with policy SWDP22 of the South Worcestershire Development Plan.
Prior to any works being undertaken to the Infant/Junior and Senior Play Areas, a working method statement shall be submitted to and agreed in writing by the local planning authority, which will ensure that impacts on the oak tree’s root system are minimised both during construction and in the long term. Reason: To prevent existing trees from being damaged during construction work and to conserve biodiversity within the area in accordance with policy SWDP22 of the South Worcestershire Development Plan.
Positive and Proactive Statement. In dealing with this application, the Council has worked with the applicant in the following ways:- providing pre-application advice; - seeking further information following receipt of the application; - seeking amendments to the proposed development following receipt of the application; - considering the imposition of conditions . In such ways the Council has demonstrated a positive and proactive manner in seeking solutions to problems arising in relation to the planning application.
Alteration of highway to provide new or amend vehicle crossover This permission does not authorise the applicant to carry out works within the publicly maintained highway since such works can only be carried out by the County Council’s Approved Contractor, Ringway Infrastructure Service who can be contacted by email worcestershirevehicle.crossing@ringway.co.uk. The applicant is solely responsible for all costs associated with construction of the access.
Works within the highway - Section 278 Agreement No work on the site should be commenced until engineering details of the improvements to the public highway have been submitted to and approved by the Highway Authority and an agreement under Section 278 of the Highways Act 1980 entered into.
