Condition Details / Information Notes
The application site lies almost entirely outside the settlement boundary of Badsey as defined under policy SWDP 2 of the South Worcestershire Development Plan 2016 (SWDP). The majority of the site is therefore defined as open countryside where development shall be strictly controlled. The proposed development fails to accord with the provisions of policy SWDP2 part C of the SWDP. The proposed development would go against the SWDP Development Strategy and the principles it is based upon (as set out under policy SWDP2) in that it would not safeguard or enhance the open countryside nor encourage the effective use or re-use of brownfield land. The SWDP has been prepared and adopted in the context of the National Planning Policy Framework (NPPF) and its contents reflect the presumption in favour of sustainable development and guide how the presumption will be applied locally. To grant planning permission would also go against one of the core planning principles as set out in para. 17 of the NPPF in that permitting development would not be plan-led. Furthermore, contrary to the case put forward in the application, the Council considers it can demonstrate that it has a five-year housing land supply and consequently that the SWDP is considered to be up to date and that its policies can be afforded full weight in decision-making. The proposed development is, therefore, contrary to adopted South Worcestershire Development Plan (2016) Policies SWDP1 and 2, as well as guidance contained in the National Planning Policy Framework (2019).
Adopted SWDP Policy 13 requires new development in villages or on sites of less than 100 dwellings to be provided at an average net density of 30 dwellings per ha (dph), whereas the proposal represents a net density of approximately 47 dwellings per ha after the requirement to provide on-site Green Infrastructure is taken into account. This is well in excess of the figure set out in SWDP13 and is considered to be unacceptable in this edge-of-village location. The justification put forward for increased density appears to be that this is a result of a likely larger proportion of smaller (1 and 2 bed) units on the site. However, given that the application is submitted in outline form, the final mix Is not known at this stage. In addition, the purpose of policy SWDP13 is not only to encourage the efficient use of land but to try and achieve development in different urban and rural settings that integrates with its surroundings in terms of built form in accordance with other policies of the plan, principally SWDP21. Consequently, a dense scheme would not be appropriate for an edge-of-village location such as this. This approach is in line with the Framework (para 122) which states the desirability of maintaining an area’s prevailing character and setting should also be taken into account when considering density.
Whilst noting the applicants willingness to enter into a Section 106 legal agreement, no secure arrangements are in place to secure: - monies in lieu of on-site formal sports pitches / built leisure facilities and potentially in lieu of sufficient on-site public open space of the range of types set out under policy SWDP39; - the provision of a contribution towards local education facilities; and - the provision of on-site affordable housing As such, the proposed development does not meet the objectives of sustainable development and cannot be delivered with acceptable impacts on the community and the environment. Therefore, the application is contrary to adopted South Worcestershire Development Plan Policies SWDP1, 7, 15 and SWDP 39 and guidance in the Council's Developer Contributions SPG and Affordable Housing SPG, as well as guidance contained in the National Planning Policy Framework.

Positive and Proactive Statement. In dealing with this application, the Council has worked with the applicant in the following ways: - providing pre-application advice; - seeking further information following receipt of the application; and - considering the imposition of conditions and/ or the completion of a s.106 legal agreement. In such ways the Council has demonstrated a positive and proactive manner in seeking solutions to problems arising in relation to the planning application. This is in accordance with paragraph 38 of the NPPF.  Despite these efforts, the Council still considers that planning permission should be refused for the reasons set out above.
