Condition Details / Information Notes
Unless where required or allowed by other conditions attached to this permission/consent, the development hereby approved shall be carried out in accordance with the information (including details on the proposed materials) provided on the application form and the following plans/drawings/documents – Location Plan (Scale 1:1250) and Proposed Elevations, Site & Block Plans PC 19 0001_02.
Reason: To define the permission.
Notwithstanding the provisions of the Town and Country Planning (General Permitted Development) Order 2015 (as amended) (or any order revoking, re-enacting, substituting, amending, extending, consolidating, replacing or modifying that Order), the premises shall not be operated as a class Sui Generis (hot food takeaway) or a mixed use under class Sui Generis (hot food takeaway) and class E(b) (sale of food and drink for consumption (mostly) on the premises), after 16th March 2021.
Reason: To ensure the proposal preserves residential amenity and to prevent unacceptable odour pollution to the detriment of human health contrary to policy SWDP31 of the South Worcestershire Development Plan.
The development hereby permitted shall be carried out in strict accordance with the information submitted with this application and recommendations made by Worcestershire Regulatory Services. In particular:
- Removal of cowl from the top of the flue;
- grease collection baffles installed within the kitchen extraction hood;
- activated carbon filter within the flue; and
- the side window serving the kitchen must remain closed during opening hours.

Positive and Proactive Statement. In dealing with this application, the Council has worked with the applicant in the following ways:
- seeking further information following receipt of the application;
- seeking amendments to the proposed development following receipt of the application. In such ways the Council has demonstrated a positive and proactive manner in seeking solutions to problems arising in relation to the planning application.
