Condition Details / Information Notes
The proposed orangery by virtue of its design/scale is not subservient to the modest single storey part of the end building that it would attach to. This has other harmful effects including the modifications required to the existing building to accommodate the extension, as well as disruption to the hierarchy of historical use in the different parts of the property and loss of architectural simplicity in the end building. In addition, there are doubts regarding whether the proposal can be made weatherproof due to the complicated links between existing and proposed structures. In these ways the extension would cause less than substantial harm to the host property and designated heritage asset, Elm House. This harm outweighs any public benefits of the scheme and therefore conflicts with guidance contained in the Framework, as well as policies SWDP6, 21 and 24 of the adopted South Worcestershire Development Plan and Policy H5 of the adopted Eckington Neighbourhood Plan.
The following plans are relevant to this decision: Aspect Design Studios 1:1250 scale Location Plan; 1:500 scale Block Plan; drawing numbers P01, P02, P03 and P04
Positive and Proactive Statement. In dealing with this application, the Council has worked with the applicant in the following ways: - seeking further information following receipt of the application; - seeking amendments to the proposed development following receipt of the application; and - considering the imposition of conditions. In such ways the Council has demonstrated a positive and proactive manner in seeking solutions to problems arising in relation to the planning application. This is in accordance with paragraph 38 of the NPPF.  Despite these efforts, the Council still considers that planning permission should be refused for the reasons set out above.
