Provision of Mushroom Growing facility (50,550 sqm), including six agricultural growing blocks (69 poly tunnels); central building including Manager's Office, cold room, canteen, toilets, showers & changing facilities; cold store and packaging building; Workshop and Machinery Storage; Farm Managers essential rural workers accommodation; floor mounted PV panels (0.227 ha); 6x Dock Levellers; Water Treatment Plant; 2no. Water Tanks; security gatehouse; provision of 122 parking spaces; balancing pond incorporating wetland habitat; associated hard and soft landscaping (including landscape bunds); security fencing, and associated infrastructure. Vehicular access will be taken from the A44. Application to involve the diversion of public footpaths (515C and 502C).
The development hereby permitted shall be begun before the expiration of three years from the date of this permission.
Reason: To conform with the requirements of Section 91 of the Town and Country Planning Act 1990 as amended by Section 51 of the Planning and Compulsory Purchase Act 2004.
Unless where required or allowed by other conditions attached to this permission/consent, the development hereby approved shall be carried out in accordance with the information (including details on the proposed materials) provided on the application form and the following plans/drawings –

Reason: To define the permission.
Before the commencement of development hereby permitted an ecological mitigation and enhancement scheme for both the construction and the operational phases of the development shall be submitted to and approved in writing by the Local Planning Authority. The scheme shall be based on the recommendations contained within the Ecological Appraisal by Environmental Dimension Partnership Ltd reference edp6346_r001c dated September 2021 and shall include Reasonable Avoidance Measures for Great Crested Newts and an implementation timetable. The works shall be carried out in accordance with the approved details and timetable and the approved mitigation measures shall be retained thereafter.
Reason: To ensure the development contributes to the conservation and enhancement of biodiversity within the site and the wider area in accordance with policy SWDP22 of the South Worcestershire Development Plan.
The development hereby approved shall not commence until a Construction Environmental Management Plan (Highways) has been submitted to and approved in writing by the Local Planning Authority. This shall include but not be limited to the following:-
• Measures to ensure that vehicles leaving the site do not deposit mud or other detritus on the public highway;
• Details of site operative parking areas, material storage areas and the location of site operatives facilities (offices, toilets etc);
• The hours that delivery vehicles will be permitted to arrive and depart, and arrangements for unloading and manoeuvring.
• Details of any temporary construction accesses and their reinstatement.
• A highway condition survey, timescale for re-inspections, and details of any reinstatement.
The measures set out in the approved Plan shall be carried out and complied with in full during the construction of the development hereby approved. Site operatives' parking, material storage and the positioning of operatives' facilities shall only take place on the site in locations approved by in writing by the Local Planning Authority.
Reason: To ensure the provision of adequate on-site facilities and in the interests of highway safety.
(A) No development shall take place until a programme of archaeological work, including a Written Scheme of Investigation, has been submitted to and approved by the local planning authority in writing. The scheme shall include an assessment of significance and research questions; and:
1) The programme and methodology of site investigation and recording.
2) The programme for post investigation assessment.
3) Provision to be made for analysis of the site investigation and recording.
4) Provision to be made for publication and dissemination of the analysis and records of the site investigation.
5) Provision to be made for archive deposition of the analysis and records of the site investigation.
6) Nomination of a competent person or persons/organisation to undertake the works set out within the Written Scheme of Investigation.
(B) The development shall not be occupied until the site investigation and post investigation assessment has been completed in accordance with the programme set out in the Written Scheme of Investigation approved under condition (A) and the provision made for analysis, publication and dissemination of results and archive deposition has been secured.
Reason: In accordance with the requirements of paragraphs 189, 194 and 199 of the National Planning Policy Framework and policies SWDP 6 and SWDP24 of the South Worcestershire Development Plan 2016.
Prior to commencement of the development hereby permitted an Employment, Skills and Local Procurement Strategy shall be submitted to and approved in writing by the Local Planning Authority. This strategy shall set out measures to provide local employment, skills and business opportunities during the construction and operational phases of the development. The development shall be carried out in accordance with the details so approved. Within 12 months of the development being brought into use, a Statement of Conformity shall be submitted to the Local Planning Authority, setting out how the approved measures were implemented and shall include a review of Employment, Skills and Procurement outcomes arising from the approved Strategy.
Reason: To ensure that the development provides opportunities for local employment and training in accordance with the economic and employment objectives of the South Worcestershire Development Plan.
The materials used in the construction of the external surfaces of the buildings hereby approved shall be as specified on the application form and approved drawings.
Reason: To protect local character and appearance in accordance with South Worcestershire Development Plan policies SWDP21 and SWDP25.
The development hereby permitted shall not be brought into use until surface water drainage facilities have been provided in accordance with the details set out in approved drawings 19-7695-SK020-P3, 19-7695-SK021-P6, 19-7695-SK030-P1, 20033.103B and 2033.104B. The surface water drainage facilities shall thereafter be maintained operational in accordance with a management and maintenance plan for the lifetime of the development which has been submitted to and approved in writing by the Local Planning Authority before the first use of the development. The management and maintenance plan shall include any arrangements for adoption by any public authority or statutory undertaker and any other arrangements to secure the operation of the scheme throughout its lifetime.
Reason: To ensure the proposed development does not exacerbate flood risk and deals with surface water run-off from the site in a sustainable manner, in accordance with policies SWDP28 and SWDP29 of the South Worcestershire Development Plan.
Prior to the first use of the development hereby permitted, the details set out in the submitted Water Management Statement (submitted as part of the Flood Risk Assessment by Complete Design Partnership dated 8 December 2020) shall be fully implemented and remain thereafter.
Reason: To ensure that an appropriate sustainable drainage system is provided to serve the development in accordance with policy SWDP29 of the South Worcestershire Development Plan.
Temporary fencing for the protection of all retained trees/hedges on site and trees outside the site whose Root Protection Areas fall within the site shall be erected in accordance with BS 5837:2012 (Trees in Relation to Design, Demolition and Construction) before development of any type commences, including site clearance, demolition, materials delivery, vehicular movement and erection of site huts.
Any alternative fencing type or position not strictly in accordance with BS 5837 (2012) must be agreed in writing by the local planning authority prior to the commencement of development.
This protective fencing shall remain in place until the completion of development or unless otherwise agreed in writing with the local planning authority. Nothing should be stored or placed (including soil), nor shall any ground levels altered, within the fenced area without the previous written consent of the local planning authority. There shall be no burning of any material within 10 metres of the extent of the canopy of any retained tree/hedge.
Reason - To prevent existing trees/hedges from being damaged during construction work and to preserve the amenities of the locality. This is in accordance with policies SWDP21 and SWDP25 of the South Worcestershire Development Plan.
All planting and seeding/turfing comprised in the approved landscape scheme detailed on drawings 0033.101G and 20033.102C shall be carried within the first planting season following the first use of the development hereby permitted. The landscaping shall thereafter be managed in accordance with the Landscape Management Plan (v2) by MHP dated 21 March 2022. Any trees or plants that die or are removed or become seriously damaged or diseased within a period of five years from the completion of the planting shall be replaced in the next planting season with others of similar size and species.
Reason: To ensure the proposed development does not have an adverse effect on the character and appearance of the area and mitigates the impact on biodiversity in accordance with policies SWDP21, SWDP22 and SWDP25 of South Worcestershire Development Plan.
The solar panels hereby permitted shall be installed on site and shall be operational before the development hereby permitted is brought into use. The panels shall thereafter remain operational.
Reason: To ensure the development supports the delivery of low carbon/renewable energy and safeguards natural resources in accordance with policy SWDP27 of the South Worcestershire Development Plan.
The development hereby permitted shall not be brought into use until the proposed sound barrier adjacent to Unit A has been installed in accordance with details including its height, extent and surface density (minimum 10kg/m2) first submitted to and approved in writing by the Local Planning Authority. The approved sound barrier shall be retained thereafter.
Reason: To protect local amenity in accordance with policies SWDP21 and SWDP31 of the South Worcestershire Development Plan.
Notwithstanding the details submitted with the application and the provisions of the Town and Country Planning (General Permitted Development) Order 2015 (or any Order revoking or re-enacting that Order with or without modification), no external lighting shall be installed at the site other than in accordance with full details first submitted to and approved in writing by the Local Planning Authority including confirmation that the luminaire Intensity at the nearest sensitive receptors will be compliant with the Institute of Lighting Engineers guidance. The details shall include specification of times when the external lighting will not be switched on.
Reason - To ensure the proposed development does not have an adverse effect on the character and appearance of the area and on local biodiversity in accordance with policies SWDP1, SWDP21, SWDP22 and SWDP25 of South Worcestershire Development Plan.
No soil or soil forming materials shall be brought onto the site other than in accordance with details first submitted to and approved in writing by the Local Planning Authority. These details must include full donor site details, proposals for contamination testing including testing schedules, sampling frequencies and allowable contaminant concentrations (as determined by appropriate risk assessment) with validatory evidence of testing (such as laboratory certificates).
Reason: To ensure that risks from land contamination to the future users of the land and neighbouring land are minimised, together with those to controlled waters, property and ecological systems, and to ensure that the development can be carried out safely without unacceptable risks to workers, neighbours and other offsite receptors in accordance with policy SWDP31 of the South Worcestershire Development Plan.
No operations other than those essential to support the growing crops overnight shall be carried out outside of the hours of 06:00 to 22:00. For the avoidance of doubt this limitation applies to all picking, packing, general maintenance and transport related activities.
Reason: To protect living conditions at nearby properties in accordance with policy SWDP21 of the South Worcestershire Development Plan.
Aside from the residential dwelling, the development hereby permitted shall be used for agricultural purposes only.
Reason: To exclude other potential uses of this countryside site and to protect local amenity in accordance with policies SWDP2, SWDP21 and SWDP25 of the South Worcestershire Development Plan.
The occupation of the dwelling hereby permitted shall be limited to a person solely or mainly working, or last working (and not working elsewhere in the meantime), in the locality in agriculture (as defined in Section 336(1) of the Town and Country Planning Act, 1990) or in forestry (“the Agricultural Worker”), or a widow, widower or surviving civil partner of the Agricultural Worker, and to any dependants residing with the Agricultural Worker or his/her widow, widower or surviving civil partner.
Reason: The proposed dwelling would be situated in the open countryside, outside any defined settlement boundary where new housing development will be strictly controlled. The proposed dwelling is justified as it serve the essential needs of an agricultural operation in line with policy SWDP19 of the South Worcestershire Development Plan. To grant permission without such a condition would be contrary to policies SWDP2 and SWDP19 of the South Worcestershire Development Plan .
No growing substrate (mushroom compost) shall be produced at the site.
Reason: to protect living conditions at nearby properties and the general amenity of the area in accordance with South Worcestershire Development Plan policies SWDP21 and SWDP31.
There shall be no open storage of materials or equipment within areas of grass, hedges and/or trees on the approved landscape drawing 20033.101G.
Reason - To ensure the proposed development does not have an adverse effect on the character and appearance of the area in accordance with policies SWDP21 and SWDP25 of South Worcestershire Development Plan.
The development hereby approved shall not be brought into use until the site access detailed on drawing 21400-01 Rev D titled ‘proposed site access’ and the access, parking and turning facilities detailed on Drawing 19-7695-SK001 P13 have been completed. These areas shall thereafter be retained available for these approved uses at all times.
Reason: In the interest of highway safety.
The development hereby approved shall not be brought into use until visibility splays are provided from a point of 1.05m above carriageway level at the centre of the access to the application site and 4.5 metres back from the near side edge of the adjoining carriageway, (measured perpendicularly), for a distance of 160 metres in each direction measured along the nearside edge of the adjoining carriageway and able to see a vertical offset of 0.6m from the carriageway. Nothing which would obstruct the visibility described above shall be planted, erected and/or allowed to grow on the triangular area of land so formed.
Reason: In the interests of highway safety.
The development hereby approved shall not be brought into use until footway/cycleway improvements indicated on drawing 21400-04 titled ‘indicative footway / cycleway tie in’ have been provided in accordance with details first submitted to and approved in writing by the Local Planning Authority and are open to use by the public for walking and cycling. The scheme must include a continuous footway / cycleway along the north side of the A44 carriageway between the development site and connecting to existing footways running alongside the A44 close to the Pinvin Junction. The footway / cycleway must thereafter be retained available for this use.
Reason: In the interest of sustainability.
Notwithstanding the details of the approved plans, the development hereby permitted shall not be brought into use until a minimum of 12 electric vehicle charging points have been installed and made operational in accordance with details first submitted to and approved in writing by the Local Planning Authority. The charging points must comply with BS EN 62196 Mode 3 or 4 charging and BS EN 61851 and have a minimum rating of 22kW. The charging points shall thereafter be retained operational.
Reason: In the interest of sustainability.
The Development hereby approved shall not be brought into use until sheltered and secure cycle parking to comply has been provided in accordance with the approved drawing 19-7694-SK001-P13 and details which have first been submitted to and approved in writing by the Local Planning Authority. The approved cycle parking shall be kept available for the parking of bicycles only thereafter.
Reason: In the interest of sustainable travel.
The Development hereby approved shall not be brought into use until a Travel Plan using Modeshift STARS Business has been submitted to and approved in writing by the Local Planning Authority. The use hereby permitted must meet green level accreditation before occupation and bronze level accreditation within 12 months of occupation. It shall thereafter be operated in accordance with the requirements of the Travel Plan.
Reason: To reduce vehicle movements and promote sustainable travel to and from the site.
Positive and Proactive Statement. In dealing with this application, the Council has worked with the applicant in the following ways:- providing pre-application advice;
- seeking further information following receipt of the application;
- seeking amendments to the proposed development following receipt of the application; and - considering the imposition of conditions. In such ways the Council has demonstrated a positive and proactive manner in seeking solutions to problems arising in relation to the planning application.
The granting of this planning permission does not remove any obligations on the applicant to undertake a technical design check of the proposed highway works with the Highway Authority, nor does it confirm acceptance of the proposal by the Highway Authority until that design check process has been concluded. Upon the satisfactory completion of the technical check the design would be suitable to allow conditions imposed under this permission to be discharged, but works to the public highway cannot take place until a legal agreement under Section 278 of the Highways Act 1980 has been entered into and the applicant has complied with the requirements of the Traffic Management Act 2004.
The applicant is urged to engage with the Highway Authority as early as possible to ensure that the approval process is started in a timely manner to achieve delivery of the highway works in accordance with the above mentioned conditions.
The applicant should be aware of the term “highway works” being inclusive of, but not limited to, the proposed junction arrangement, street lighting, structures and any necessary traffic regulation orders.
The attention of the applicant is drawn to Section 59 of the Highways Act 1980 which allows the Highway Authority to recover additional costs of road maintenance due to damage by extraordinary traffic.
Before any work is commenced upon the development hereby approved representatives of Worcestershire County Council, as the Highway Authority and the applicant, shall carry out a joint road survey/inspection on the roads leading to this site. Any highlighted defects shall be rectified to the specification and satisfaction of the Highway Authority before work is commenced on the development hereby approved. A further joint survey/inspection shall be undertaken following completion of development hereby approved and any necessary remedial works shall be completed to the specification and satisfaction of the Highway Authority within 1 month or other agreed timescale.
Modeshift STARS Business is a nationally accredited scheme which assists in the effective delivery of travel plans, applicant can register at www.modeshiftstars.org.
In order for WCC to transfer the Travel Plan to Modeshift Stars, the WCC Travel Plan Officer will require the following information:
- Application reference
- Contact details i.e. email and phone number for Alan Walsh
- The postcode of the site
- Expected opening hours and shifts
- Expected number of daily visitors
- Number of visitor car park spaces
- What fleet vehicles they would have
- Estimated occupation date – this can be an aspirational date at this point

Drainage arrangements shall be provided to ensure that surface water from the driveway and/or vehicular turning area does not discharge onto the public highway. No drainage or effluent from the proposed development shall be allowed to discharge into any highway drain or over any part of the public highway.
The applicant's attention is drawn to the need to ensure that the provision of the visibility splay(s) required by this consent is safeguarded in any sale of the application site or part(s) thereof.
It is expected that contractors are registered with the Considerate Constructors scheme and comply with the code of conduct in full, but particular reference is made to "respecting the community" this says:
Constructors should give utmost consideration to their impact on neighbours and the public
• Informing, respecting and showing courtesy to those affected by the work.
• Minimising the impact of deliveries, parking and work on the public highway.
• Contributing to and supporting the local community and economy.
• Working to create a positive and enduring impression, and promoting the Code.
The CEMP should clearly identify how the principle contractor will engage with the local community, this should be tailored to local circumstances. Contractors should also confirm how they will manage any local concerns and complaints and provide an agreed Service Level Agreement for responding to said issues.
Contractors should ensure that courtesy boards are provided and information shared with the local community relating to the timing of operations and contact details for a site coordinator in the event of any difficulties.
This does not offer any relief to obligations under existing Legislation.
In order to minimise any nuisance during the construction phase from noise, vibration and dust emissions the applicant should refer to the WRS Best Practice Guidance (https://www.worcsregservices.gov.uk/media/1k2nma3t/wrs-contractor-guidance-2nd-editon-v10.pdf) and ensure its recommendations are complied with.
Application should be made to the planning authority to divert any public rights of way mentioned as part of the submitted documents prior to the commencement of the development. Note -
• No disturbance of, or change to, the surface of the path or part thereof should be carried out without written consent from the County Highway Authority.
• No diminution in the width of the right of way available for use by the public.
• Buildings materials must not be stored on the right of way.
• Vehicle movements and parking to be arranged so as not to unreasonably interfere with the public’s use of the right of way.
• No additional barriers are placed across the right of way. No stile, gate, fence or other structure should be created on, or across, a public right of way without written consent of the County Highway Authority.
• The safety of the public using the right of way is to be ensured at all times.
The applicant should note the National Planning Policy Framework published in July 2018 by the Ministry of Housing, Communities and Local Government, particularly paragraph 98, to ensure that planning policies protect and enhance public rights of way and access. The developer should also be aware of the Department of Environment Circular 1/09 (part 7) which explains that the effect of development on a public right of way is a material consideration in the determination of applications for planning permission and that the grant of planning consent does not entitle developers to obstruct a public right of way.
The Definitive Map is a minimum record of public rights of way and does not preclude the possibility that unrecorded public rights may exist, nor that higher rights may exist than those shown.
