Condition Details / Information Notes
The development hereby permitted shall be begun before the expiration of three years from the date of this permission. Reason: To conform with the requirements of Section 91 of the Town and Country Planning Act 1990 as amended by Section 51 of the Planning and Compulsory Purchase Act 2004.
Unless where required or allowed by other conditions attached to this permission/consent, the development hereby approved shall be carried out in accordance with the information (including details on the proposed materials) provided on the application form and the following plans/drawings/documents – Location Plan 1:1250 scale Rev B Block Plan 1:500 scale Rev B 2011/62/1 Rev A 2011/62/2 Rev A Reason: To define the permission.
No development above slab floor level of the utility block shall take place until details of the materials to be used in the construction of the external surfaces of the development hereby permitted have been submitted to and approved in writing by the local planning authority. The development shall be carried out using the materials as approved. Reason - To ensure that the new materials are in keeping with the surroundings and/or represent quality design in accordance with policy SWDP21 of the South Worcestershire Development Plan.
The site shall not be occupied by any persons other than gypsies and travellers as defined in Annex 1: Glossary paragraph 1 of the Communities and Local Government Planning Policy for Traveller Sites. Reason - As the use of the site for residential purposes would only be in accordance with planning policy if occupied by gypsy/traveller persons in accordance with Policy SWDP 17 of the South Worcestershire Development Plan.
The residential use hereby permitted shall be restricted to the stationing of no more than 8 caravans, as defined in the Caravan Sites and Control of Development Act 1960 and the Caravan Sites Act 1968, at any time (of which no more than 4 shall be a static caravan). Reason - To ensure that the proposed development does not adversely affect the character/appearance of the landscape and general environment, in accordance with Policies SWDP 17 and SWDP 21 of the South Worcestershire Development Plan.
The site shall not be used for any trade or business purpose other than as a home base for light vehicles used by the occupants of the site for the purposes of making their livelihood off site. In particular, no materials associated with such activities shall be stored in the open on the site Reason - To ensure that the proposed development does not adversely affect the character/appearance of the landscape and general environment, in accordance with Policies SWDP 17 and SWDP 21 of the South Worcestershire Development Plan.
No vehicle over 3.5 tonnes shall be stationed, parked or stored on this site. Reason - To ensure that the proposed development does not adversely affect the character/appearance of the landscape and general amenities of the area, in accordance with policies SWDP 17 and SWDP 21 of the South Worcestershire Development Plan.
The development and caravans as approved shall be sited/laid out in accordance with the proposed Block Plan 1:500 scale Rev B. Reason - To ensure that the proposed development does not adversely affect the character/appearance of the landscape and general environment, in accordance with policies SWDP 21 and SWDP 25 of the South Worcestershire Development Plan.
Before the first use of the development hereby permitted a scheme of landscaping shall be submitted to and approved in writing by the Local Planning Authority. The landscaping scheme shall include:- (i) a plan(s) showing details of all existing trees and hedges on the application site. The plan should include, for each tree/hedge, the accurate position, canopy spread and species, together with an indication of any proposals for felling/pruning and any proposed changes in ground level, or other works to be carried out, within the canopy spread. (ii) a plan(s) showing the layout of proposed tree, hedge and shrub planting and grass areas. (iii) a schedule of proposed planting - indicating species, sizes at time of planting and numbers/densities of plants. (iv) a written specification outlining cultivation and other operations associated with plant and grass establishment. (v) a schedule of maintenance, including watering and the control of competitive weed growth, for a minimum period of five years from first planting. All planting and seeding/turfing shall be carried out in accordance with the approved details in the first planting and seeding/turfing seasons following the completion or first occupation/use of the development, whichever is the sooner. The planting shall be maintained in accordance with the approved schedule of maintenance. Any trees or plants which, within a period of five years from the completion of the planting, die, are removed or become seriously damaged or diseased shall be replaced in the next planting season with others of similar size and species. Reason - To ensure the proposed development does not have an adverse effect on the character and appearance of the area in accordance with policies SWDP21 and SWDP25 of South Worcestershire Development Plan.
Prior to the first use of the development hereby permitted, the details set out in the submitted Water Management Statement shall be fully implemented and remain thereafter. Reason: To ensure that an appropriate sustainable drainage system is provided to serve the development in accordance with policy SWDP29 of the South Worcestershire Development Plan 2016.
The dayroom hereby permitted shall be used solely for purposes ancillary to the use of the site as a residential caravan site for gypsies and shall at no time be used as a separate unit of residential accommodation. Reason - To define the use of the building
Prior to the first use of the development hereby permitted, details of biodiversity enhancement measures based on the recommendations of the Walkover PEA Survey by Michelle Young dated April 2021, shall be submitted to and approved in writing by the Local Planning Authority.  The details to be submitted shall include an implementation timetable. The features shall be provided in accordance with the approved details and in accordance with the approved timetable. Reason: To ensure the development contributes to the conservation and enhancement of biodiversity within the site and the wider area in accordance with policy SWDP22 of the South Worcestershire Development Plan.
Before the first use of the development hereby permitted a plan indicating the positions, design, materials and type of boundary treatment to be erected shall be submitted to and approved in writing by the local planning authority The boundary treatment shall be completed before the first use of the development hereby permitted. Development shall be carried out in accordance with the approved details. Reason - To protect the amenities of properties and ensure the proposed development does not have an adverse effect on the character and appearance of the area in accordance with policies SWDP21 and SWDP25 of South Worcestershire Development Plan..
Before the development hereby permitted is first used, details of any external lighting to be provided in association with the development shall be submitted to and approved in writing by the Local Planning Authority. The details shall include times when the external lighting will not be switched on. Only external lighting in accordance with approved details shall be provided on the application site. Notwithstanding the provisions of the Town and Country Planning (General Permitted Development) Order 2015 (or any Order revoking or re-enacting that Order with or without modification) there shall be no other external lighting provided on the application site. Reason - To ensure the proposed development does not have an adverse effect on the character and appearance of the area in accordance with policies SWDP1, SWDP21 and SWDP25 of South Worcestershire Development Plan and to ensure the development contributes to the conservation and enhancement of biodiversity within the site and the wider area in accordance with policy SWDP22 of the South Worcestershire Development Plan.
The development hereby approved shall not be first used until the first 5 m of the access into the development, measured from the edge of the carriageway, has been surfaced in a bound material. Reason: In the interests of highway safety in accordance with Policies SWDP4 and SWDP 21 of the South Worcestershire Development Plan.
The development hereby permitted shall not be first used until sheltered and secure parking for cycles to comply with the Council’s adopted highway design guide has been provided in accordance with details which shall first be submitted to and approved in writing by the Local Planning Authority. The approved cycle parking shall be retained thereafter and be kept available for the parking of cycles only. Reason - To comply with the Council’s parking standards
The development hereby permitted shall not be brought into use until the access, turning area and parking facilities shown on the Block Plan 1:500 scale Rev B has been provided. These areas shall thereafter be retained and kept available for those uses at all times. Reason - In the interests of highway safety and to ensure the free flow of traffic using the adjoining highway in accordance with Policies SWDP 4 and SWDP 21 of the South Worcestershire Development Plan.
Positive and Proactive Statement In dealing with this application, the Council has worked with the applicant in the following ways:- - seeking further information following receipt of the application; and - considering the imposition of conditions and/or the completion of a s.106 legal agreement. In such ways the Council has demonstrated a positive and proactive manner in seeking solutions to problems arising in relation to the planning application.
This permission does not authorise the applicant to carry out works within the publicly maintained highway since such works can only be carried out by the County Council's Approved Contractor, Ringway Infrastructure Services who can be contacted by email worcestershirevehicle.crossing@ringway.co.uk. The applicant is solely responsible for all costs associated with the construction of the access.
