Application for the approval of all reserved matters shall be made to the Local Planning Authority before the expiration of three years from the date of this permission. The development hereby permitted shall be begun before the expiration of two years from the date of approval of the last of the reserved matters to be approved.
Reason: In accordance with the requirements of Section 92 of the Town and Country Planning Act 1990 as amended by Section 51 of the Planning and Compulsory Purchase Act 2004. |
Approval of the details of the appearance, landscaping, layout and scale, hereinafter called ""the reserved matters"", shall be obtained from the Local Planning Authority in writing before any development is commenced. The development shall be carried out in accordance with approved reserved matter details.
Reason: Required to be imposed pursuant to Section 92 of the Town and Country Planning Act 1990 (as amended) and to enable to the Local Planning Authority to exercise proper control over these aspects of the development |
Unless where required or allowed by other conditions attached to this permission/consent, the development hereby approved shall be carried out in accordance with the information (including details on the proposed materials) provided on the application form and the following plans/drawings/documents –

Details of screen walls, fences, surface treatments to drives, cycle and footways and implementation timetable shall be submitted for approval as part of the landscaping reserved matters.
Reason: To ensure the proposed development does not have an adverse effect on the character and appearance of the area in accordance with policies SWDP21 and SWDP25 of South Worcestershire Development Plan. |
The following details shall be submitted for approval as part of the landscaping reserved matters:-
1. survey information of all existing trees and hedges on the application site, and branches from trees on adjacent land that overhang the site. The survey shall include for each tree/hedge:
a) the accurate position, canopy spread and species plotted on a plan;
b) an assessment of its general health and stability;
c) an indication of any proposals for felling or pruning;
d) details of any proposed changes in ground level, or other works to be carried out, within the canopy spread.
2. a landscape scheme which shall include:
a) a plan(s) showing the planting layout of proposed tree, hedge, shrub and grass areas;
b) a schedule of proposed planting – indicating species, size at time of planting and numbers/densities of plants;
c) a written specification outlining cultivation and others operations associated with plant and grass establishment;
d) a schedule of maintenance, including watering and the control of competitive weed growth, for a minimum period of five years from first planting.
The landscaping shall be provided and maintained in accordance with the approved details.
Reason: To preserve and enhance the visual amenities of the area and to ensure the satisfactory development of the site - in accordance with policies SWDP21, SWDP25 of the South Worcestershire Development Plan.

The development hereby permitted should not commence until drainage plans for the disposal of foul and surface water flows have been submitted to and approved by the Local Planning Authority. The scheme shall be implemented in accordance with the approved details before the development is first brought into use.
Reason: to ensure that the development is provided with a satisfactory means of drainage as well as to prevent or to avoid exacerbating any flooding issues and to minimise the risk of pollution in accordance with policies SWDP 28, 29 and 20 of the South Worcestershire Development Plan.

No works in connection with site drainage shall commence until infiltration tests have been carried out in accordance with BRE Digest 365, or such other guidance as may be agreed in writing by the Local Planning Authority. The results of the tests shall be submitted to and agreed in writing by the Local Planning Authority and the agreed recommendations shall be implemented in full prior to the first use of the development hereby approved.
Reason: to ensure that the development is provided with a satisfactory means of drainage as well as to prevent or to avoid exacerbating any flooding issues and to minimise the risk of pollutioin accordance with policy SWDP30 of the South Worcestershire Development Plan. |
No works in connection with site drainage shall commence until a SuDS management plan which will include details on future management responsibilities, along with maintenance schedules for all SuDS features and associated pipework has been submitted to and approved in writing by the Local Planning Authority. This plan shall detail the strategy that will be followed to facilitate the optimal functionality and performance of the SuDS scheme throughout its lifetime. The approved SuDS management plan shall be implemented in full in accordance with the agreed terms and conditions and shall be managed and maintained in accordance with the approved maintenance plan and thereafter.
Reason: to ensure that the development is provided with a satisfactory means of drainage as well as to prevent or to avoid exacerbating any flooding issues and to minimise the risk of pollution in accordance with policy SWDP 28 and 29 of the South Worcestershire Development Plan. |
No development shall take place, including any works of until a Construction Environment Management Plan has been submitted to and approved in writing by the Local Planning Authority. The approved statement shall be adhered to throughout the construction period.
The statement shall provide for:
a) The parking of vehicles of site operatives and visitors within the application site.
b) Loading and unloading of plant and materials within the application site.
c) Storage of plant and materials within the application site.
d) Measures to ensure that vehicles leaving the site do not deposit mud or other detritus on the public highway.
e) Measures to control the emission of dust and dirt during construction
f) Responsible persons and lines of communication.
g) Details of the routing of HGV, s and delivery lorries on the highway network associated with the proposed development to and from the site together with agreed traffic management measures.
Reason: To protect existing and new occupiers of residential areas from the unreasonable effects of construction in respect of noise, vibration, light and dust nuisance, in accordance with Policies SWDP4 and 21 of the South Worcestershire Development Plan. |
Demolition, clearance or construction work and deliveries to and from the site in connection with the development hereby approved shall only take place between the hours of 08.00 and 18.00hrs Monday to Friday and 08.00 and 13.00hrs on a Saturday. There shall be no demolition, clearance or construction work or deliveries to and from the site on Sundays or Bank Holidays.
Reason: To preserve the amenities of the locality in accord with Policy SWDP21 of the South Worcestershire Development Plan. |
Before the commencement of development hereby permitted an ecological mitigation and enhancement scheme shall be submitted to and approved in writing by the local planning authority. The scheme shall include an implementation timetable. The works shall thereafter be carried out in accordance with the approved details and timetable.
Reason: To ensure the development contributes to the conservation and enhancement of biodiversity within the site and the wider area in accordance with policy SWDP22 of the South Worcestershire Development Plan. |
Before the commencement of development hereby permitted, details of renewable and/or low carbon energy generation measures shall be submitted to and approved in writing by the Local Planning Authority. The measures shall contribute to at least 10% of the predicted energy requirements of the development. The details to be submitted shall include:-
- the overall predicted energy requirements of the approved development;
- the predicted energy generation from the proposed renewable/low carbon energy measures; and
- an implementation timetable for the proposed measures.
The development shall be carried out in accordance with the approved details.
Reason: To ensure the development supports the delivery of low carbon/renewable energy and safeguards natural resources in accordance with policy SWDP27 of the South Worcestershire Development Plan. |
Positive and Proactive Statement. No problems have arisen in dealing with this application. The planning application sought an acceptable form of development consistent with the requirements of relevant policies and material considerations. No amendments or alterations were therefore required and no further positive or proactive action was deemed necessary. |
The Development hereby permitted shall not be first occupied until sheltered and secure cycle parking to comply with the Council’s adopted highway design guide has been provided in accordance with details which shall first be submitted to and approved in writing by the Local Planning Authority and thereafter the approved cycle parking shall be kept available for the parking of bicycles only.
Reason: To comply with the Council’s parking standards in accordance with Policies SWDP 4 and SWDP 21 of the South Worcestershire Development Plan. |

Development shall not begin until visibility splays are provided from a point 0.6m above carriageway level at the centre of the junction to the application site and 2.4 metres back from the near side edge of the adjoining carriageway, (measured perpendicularly), for a distance of 57 metres in a southerly direction and 55m measured in a northerly direction along the nearside edge of the adjoining carriageway. Nothing shall be planted, erected and/or allowed to grow on the triangular area of land so formed which would obstruct the visibility described above.
Reason: In the interests of highway safety and to ensure the free flow of traffic using the adjoining highway in accordance with Policies SWDP 4 and SWDP 21 of the South Worcestershire Development Plan. |
The Development hereby approved shall not be brought into use until the existing vehicular crossing and entrance to Offenham Road shall be permanently closed in accordance with details that shall have been submitted to and approved in writing by the Local Planning Authority.
Reason: To ensure the safe and free flow of traffic using the adjoining highway in accordance with Policies SWDP 4 and SWDP 21 of the South Worcestershire Development Plan. |
Prior to the first occupation any dwelling hereby approved, space shall be laid out within the application site for the parking to comply with the Worcestershire County Councils Streetscape Design Guide standards. The parking and turning areas shall be properly consolidated, surfaced and drained in accordance with details to be submitted to and approved in writing by the Local Planning Authority and these areas shall not thereafter be used for any other purpose than the parking and turning of vehicles.
Reason: In the interests of highway safety in accordance with Policies SWDP 4 and SWDP 21 of the South Worcestershire Development Plan. |
The Development hereby permitted shall not be first occupied until the proposed garages / dwellings have been fitted with an electric vehicle charging point. The charging points shall comply with BS EN 62196 Mode 3 or 4 charging and BS EN 61851 and the Worcestershire County Council Streetscape Design Guide. The electric vehicle charging points shall be retained for the lifetime of the development unless they need to be replaced in which case the replacement charging point(s) shall be of the same specification or a higher specification in terms of charging performance.
Reason: To encourage sustainable travel and healthy communities in accordance with Policy SWDP21 of the South Worcestershire Development Plan. NPPF Paragraphs 105 and 110 of the NPPF state; ’If setting local parking standards for residential and non-residential development, policies should take into account the need to ensure an adequate provision of spaces for charging plug-in and other ultra-low emission vehicles’ and ‘Applications for development should be designed to enable charging of plug-in and other ultra-low emission vehicles in safe, accessible and convenient locations.’ |
The Development hereby approved shall not be occupied until the applicant has submitted to and had approval in writing from the Local Planning Authority a residential Travel Welcome Pack promoting sustainable forms of access to the development. The pack shall be provided to each resident at the point of occupation.
Reason: To reduce vehicle movements and promote sustainable access in accordance with Policies SWDP 4 and SWDP 21 of the South Worcestershire Development Plan. |
The applicant is requested to use his best endeavours to ensure that all construction and delivery vehicles in connection with the development authorised by this permission to submit details of the routing of construction and delivery vehicles on the highway network associated with the proposed development to and from the site together with agreed traffic management measures have been submitted to and approved in writing by the Local Planning Authority in consultation with the Highway Authorities to ensure that the construction traffic associated with the proposed development keeps to the designated route. |
The granting of this planning permission does not remove any obligations on the applicant to undertake a technical design check of the proposed highway works with the Highway Authority, nor does it confirm acceptance of the proposal by the Highway Authority until that design check process has been concluded. Upon the satisfactory completion of the technical check the design would be suitable to allow conditions imposed under this permission to be discharged but works to the public highway cannot take place until a legal agreement under Section 278 of the Highways Act 1980 has been entered into and the applicant has complied with the requirements of the Traffic Management Act 2004.
The applicant is urged to engage with the Highway Authority as early as possible to ensure that the approval process is started in a timely manner to achieve delivery of the highway works in accordance with the above-mentioned conditions.
The applicant should be aware of the term “highway works” being inclusive of, but not limited to, the proposed junction arrangement, street lighting, structures, and any necessary traffic regulation orders. |
If it is the applicant's intention to request the County Council, as Highway Authority, to adopt the proposed roadworks as maintainable at the public expense, then details of the layout and alignment, widths and levels of the proposed roadworks, which shall comply with any plans approved unless otherwise agreed in writing, together with all necessary drainage arrangements and run off calculations shall be submitted to the County Council's Network Control Manager, Worcestershire County Council, County Hall, Spetchley Road, Worcester, WR5 2NP. No works on the site of the development shall be commenced until these details have been approved by the County Council as Highway Authority and an Agreement under Section 38 of the Highways Act, 1980, entered into. |
It is not known if the proposed roadworks can be satisfactorily drained to an adequate outfall. Unless adequate storm water disposal arrangements can be provided, the County Council, as Highway Authority, will be unable to adopt the proposed roadworks as public highways.
The applicant is, therefore, advised to submit the engineering details referred to in this conditional approval to the County Council's County Network Control Manager, Worcestershire County Council, County Hall, Spetchley Road, Worcester, WR5 2NP at an early date to enable surface water disposal arrangements to be assessed |
This permission does not authorise the re-siting of any street lighting columns or illuminated road traffic sign(s) affected by the proposed development. The applicant should contact the Network Control Manager, Worcestershire County Council, County Hall, Spetchley Road, Worcester WR5 2NP for the necessary approval. Precise details of all works within the public highway must be agreed with the Highway Authority. |
(A) The reserved matters application shall not be submitted until a programme of archaeological work, including a Written Scheme of Investigation for mitigation, has been approved by the local planning authority in writing. The scheme shall include an assessment of significance, research questions; and:
1) The programme and methodology of site investigation and recording.
2) The programme for post investigation assessment.
3) Provision to be made for analysis of the site investigation and recording.
4) Provision to be made for publication and dissemination of the analysis and records of the site investigation.
5) Provision to be made for archive deposition of the analysis and records of the site investigation.
6) Nomination of a competent person or persons/organisation to undertake the works set out within the Written Scheme of Investigation.
(B) The reserved matters application shall not be submitted until the site investigation and post investigation assessment has been completed in accordance with the programme set out in the Written Scheme of Investigation approved under condition (A) and the provision made for analysis, publication and dissemination of results and archive deposition has been secured.
Reason: In accordance with the requirements of paragraphs 194 and 205 of the National Planning Policy Framework 2012 (as amended) and SWDP 6 & 24 of the South Worcestershire Development Plan 2016. |
