The development hereby permitted shall be begun before the expiration of three years from the date of this permission.
Reason: To conform with the requirements of Section 91 of the Town and Country Planning Act 1990 as amended by Section 51 of the Planning and Compulsory Purchase Act 2004. |
Unless where required or allowed by other conditions attached to this permission, the development hereby approved shall be carried out in accordance with the information provided on the application form and the following plans/drawings: P2021-16-01, P2021-16-02B, P2021-16-03B, P2021-16-04D, P2021-16-05C, P2021-16-06, P2021-16-07B and P2021-16-09A.
Reason: To define the permission. |
Construction work on the buildings hereby approved shall not begin until the precise floor slab levels of each new building, relative to the existing site levels and the adjacent roadway have been submitted to and approved in writing by the Local Planning Authority. Thereafter the new buildings shall be constructed at the approved floor slab levels.
Reason: To ensure the proposed development does not have an adverse effect on the character and appearance of the area in accordance with policies SWDP21 and SWDP25 of South Worcestershire Development Plan. |
Temporary fencing for the protection of all retained trees/hedges on site and trees outside the site whose Root Protection Areas fall within the site shall be erected in accordance with BS 5837:2012 (Trees in Relation to Design, Demolition and Construction) before development of any type commences, including site clearance, demolition, materials delivery, vehicular movement and erection of site huts.
Any alternative fencing type or position not strictly in accordance with BS 5837 (2012) must be agreed in writing by the Local Planning Authority prior to the commencement of development.
This protective fencing shall remain in place until the completion of development or unless otherwise agreed in writing with the local planning authority. Nothing should be stored or placed (including soil), nor shall any ground levels altered, within the fenced area without the previous written consent of the local planning authority. There shall be no burning of any material within 10 metres of the extent of the canopy of any retained tree/hedge.
Reason: To prevent existing trees/hedges from being damaged during construction work and to preserve the amenities of the locality. In accordance with policies SWDP21 and SWDP25 of South Worcestershire Development Plan. |
Notwithstanding the submitted landscaping details on drawing P2021-16-03B, a revised soft landscaping scheme including additional hedge and tree planting on the back (western) boundary shall be submitted to and approved in writing by the Local Planning Authority before any above ground construction works on the development hereby permitted are begun. The landscaping scheme shall include:-
(i) a plan showing details of all existing trees and hedges on the application site including the accurate position, canopy spread and species, together with an indication of any proposals for felling/pruning and any proposed changes in ground level, or other works to be carried out, within the canopy spread; and
(ii) a plan showing the layout of proposed tree, hedge and shrub planting and grass areas.
All planting and seeding/turfing shall be carried out in accordance with the approved details and the submitted Planting and Maintenance Schedule for 5 year period by Jim Lowden dated 24 August 2021 in the first planting and seeding/turfing seasons following the completion or first occupation/use of the development, whichever is the sooner.
The planting shall thereafter be maintained in accordance with that same Schedule. Any trees or plants which, within a period of five years from the completion of the planting, die, are removed or become seriously damaged or diseased shall be replaced in the next planting season with others of similar size and species.
Reason: To ensure the proposed development does not have an adverse effect on the character and appearance of the area in accordance with policies SWDP21 and SWDP25 of South Worcestershire Development Plan. |
Before the commencement of development hereby permitted, details of renewable and/or low carbon energy generation measures shall be submitted to and approved in writing by the Local Planning Authority. The measures shall contribute to at least 10% of the predicted energy requirements of the development. The details to be submitted shall include:-
- the overall predicted energy requirements of the approved development;
- the predicted energy generation from the proposed renewable/low carbon energy measures; and
- an implementation timetable for the proposed measures.
The development shall be carried out in accordance with the approved details.
Reason: To ensure the development supports the delivery of low carbon/renewable energy and safeguards natural resources in accordance with policy SWDP27 of the South Worcestershire Development Plan. |
The materials used in the construction of the external surfaces of the buildings hereby permitted shall be in accordance with the details shown on the application form and approved drawings P2021-16-05C and P2021-16-09A.
Reason: To ensure that the new materials are in keeping with the surroundings and represent quality design in accordance with policy SWDP21 of the South Worcestershire Development Plan.

The development hereby permitted shall not be first occupied until the proposed dwelling has been fitted with an electric vehicle charging point. The charging point shall comply with BS EN 62196 Mode 3 or 4 charging and BS EN 61851 and the Worcestershire County Council Streetscape Design Guide. The electric vehicle charging points shall be retained for the lifetime of the development unless they need to be replaced in which case the replacement charging point(s) shall be of the same specification or a higher specification in terms of charging performance.
Reason: To encourage sustainable travel and healthy communities. |
The development hereby approved shall not be occupied until the access, turning area and parking facilities shown on drawing P2021-016/07B have been provided. These areas shall thereafter be retained and kept available for their respective approved uses at all times.
Reason: In the interests of highway safety and to ensure the free flow of traffic using the adjoining highway. |
Prior to the first use/occupation of the development hereby permitted, the details set out in the submitted Water Management Statement reference P2021-016-08B shall be fully implemented and remain thereafter.
Reason: To ensure that an appropriate sustainable drainage system is provided to serve the development in accordance with policy SWDP29 of the South Worcestershire Development Plan 2016. |
All existing buildings shown on site plan P2021-016-03B shall be demolished prior to first occupation of the house hereby permitted.
Reason: To ensure the removal of the existing poor quality structures and ensure that the existing bungalow is fully demolished, in the interest of the character and appearance of the area and in accordance with South Worcestershire Development Plan policies SWDP18 and SWDP21. |
Notwithstanding the provisions of the Town and Country Planning (General Permitted Development) Order 2015 (as amended) (or any order revoking, re-enacting, substituting, amending, extending, consolidating, replacing or modifying that Order), no extensions or alterations normally permitted under Schedule 2 Part 1 Classes A, AA or B of that Order shall be made without the submission and approval of a separate application for planning permission.
Reason: In order to ensure the proposal would accord with the provisions of policy SWDP18 iii and to protect local character and appearance. |
Positive and Proactive Statement. In dealing with this application, the Council has worked with the applicant by seeking further information and amendments following receipt of the application and considering the imposition of conditions. In such ways the Council has demonstrated a positive and proactive manner in seeking solutions to problems arising in relation to the planning application. |
Alteration of highway to provide new or amended vehicle crossover -
This permission does not authorise the applicant to carry out works within the publicly maintained highway since such works can only be carried out by the County Council’s Approved Contractor, Ringway Infrastructure Service who can be contacted by email worcestershirevehicle.crossing@ringway.co.uk. The applicant is solely responsible for all costs associated with construction of the access. |
It should be not4ed that the definitive line of Grafton Flyford footpath GF-527 is adjacent to the southern boundary of the application site, as indicated on the submitted Location and Site Plans. Where there is planting, or where planting is proposed, in the vicinity of the footpath, care must be taken to ensure that, once mature, it will not reduce its existing width or block the definitive line.
The applicant should also be aware of and adhere to the following general obligations towards the right of way:
• No disturbance of, or change to, the surface of the path or part thereof should be carried out without our written consent.
• There must be no diminution in the width of the right of way available for use by the public.
• Building materials must not be stored on the right of way.
• Vehicle movements and parking to be arranged so as not to unreasonably interfere with the public’s use of the right of way.
• No additional barriers are to be placed across the right of way. No stile, gate, fence or other structure should be created on, or across, a public right of way without the written consent of the Highway Authority.
• The safety of the public using the right of way is to be ensured at all times. |
