Condition Details / Information Notes
The development hereby permitted shall be begun before the expiration of three years from the date of this permission. Reason - In accordance with the requirements of Section 91 (1) of the Town and Country Planning Act 1990 as amended by Section 51 of the Planning and Compulsory Purchase Act 2004.
The development hereby permitted shall be carried out in accordance with the following approved plans: INC-SA[20]0001 INC-SA[20]0002 INC-SA[20]0005 INC-MA[20]0005 INC-MA[20]0006 INC-MA[21]0001 INC-MA[21]0002 INC-MA[21]0005 Reason - In order to define the permission.
Details of the form, colour and finish of the materials to be used externally on the walls and roofs shall be subject to the approval, in writing, of the Local Planning Authority before any work on the site commences. The development shall be carried out using the materials as approved. Reason - To ensure that the development is visually satisfactory, in accordance with saved Policies GD2 and SUR1 of the Wychavon District Local Plan (June 2006)
The development hereby permitted shall not be occupied until the access, turning area and parking facilities shown on the approved plan have been properly consolidated, surfaced, drained and otherwise constructed in accordance with details to be submitted to and approved in writing by the Local Planning Authority and these areas shall thereafter be retained and kept available for those uses at all times. Reason - In the interests of highway safety and to ensure the free flow of traffic using the adjoining highway, in accordance with saved Policy GD2 of the Wychavon District Local Plan (June 2006)
Development shall not begin until drainage works have been carried out in accordance with details to be submitted to and approved in writing by the local planning authority. Reason - To ensure a satisfactory means of drainage is available to serve the development, in accordance with saved Policies GD2 and ENV19 of the Wychavon District Local Plan (June 2006)
No part of the development shall be commenced until full details of soft landscaping works have been submitted to and approved in writing by the Local Planning Authority. The details submitted must include: i) a plan(s) showing details of all existing trees and hedges on the application site. The plan should include, for each tree/hedge, the accurate position, canopy spread and species, together with an indication of any proposals for felling/pruning and any proposed changes in ground level, or other works to be carried out, within the canopy spread. ii) a plan(s) showing the layout of proposed tree, hedge and shrub planting and grass areas. iii) a schedule of proposed planting - indicating species, sizes at time of planting and numbers/densities of plants. iv) a written specification outlining cultivation and other operations associated with plant and grass establishment. v) a schedule of maintenance, including watering and the control of competitive weed growth, for a minimum period of five years from first planting. All planting and seeding/turfing shall be carried out in accordance with the approved details in the first planting and seeding/turfing seasons following the completion or first occupation/use of the development, whichever is the sooner. Any trees or plants which, within a period of five years from the completion of the planting, die, are removed or become seriously damaged or diseased shall be replaced in the next planting season with others of similar size and species, unless otherwise agreed in writing by the Local Planning Authority. Reason - To protect and enhance the visual amenities of the area and to ensure the satisfactory development of the site, in accordance with saved Policies GD2 and ENV1 of the Wychavon District Local Plan (June 2006).
All existing trees and hedges on site, or branches from trees on adjacent land that overhang the site, unless indicated on the approved plan(s) to be removed, shall be retained and shall not be felled or pruned or otherwise removed within a period of five years from the completion of the development without the previous written consent of the Local Planning Authority. There shall be no burning of any material within 10 metres of the extent of the canopy of any retained tree/hedge. If any retained tree/hedge is removed, uprooted or destroyed or dies, replacement planting shall be carried out in the first available planting season of such species, sizes and numbers and in positions on site as may be specified by the Local Planning Authority. Reason - To prevent existing trees/hedges from being damaged during construction work and to preserve the amenities of the locality. In accordance with saved Policy SUR2 of the Wychavon District Local Plan (June 2006).
The removal of the ivy and roof of the garage shall be carried out by hand and shall occur between late September and late March of any given year with a licensed bat ecologist present acting as an 'Ecological Clerk of Works'. The removal of the roof of the dwelling shall occur between late October and early March of any given year with a licensed bat ecologist on standby for the event that evidence of roosting bats is found. On completion of these works a brief confirmation letter shall be submitted to the local planning authority for approval. Reason: To ensure protected species are not harmed by the development in accordance with saved Policy ENV6 of the Wychavon District Local Plan (June 2006)
Prior to the commencement of the development hereby permitted details of suitable bat roosting features shall be submitted to and approved in writing with the local planning authority and shall thereafter be installed as agreed. These shall include a replacement bat loft, a minimum of 4 bat boxes installed on mature trees and at least 2 bat roosting features such as modified ridge tiles and / or bat bricks incorporated into the design of the building. Reason: To ensure appropriate habitat provision in accordance with paragraph 118 of the Framework.
Exterior lighting shall be low-powered, downward-pointing and directed away from bat roosts, unless otherwise agreed in writing with the local planning authority. Reason: To ensure protected species are not harmed by the development in accordance with paragraphs 109 and 118 of the Framework.
The existing dwelling within the application site shall be demolished prior to the first occupation of the replacement dwelling hereby approved. Reason - T ensure only one dwelling is maintained on site, in accordance with saved Policy RES9 of the Wychavon District Local Plan (June 2006)
Notwithstanding the provisions of the Town and Country Planning (General Permitted Development) Order 1995, as amended, nothing in Article 3 and Schedule 2 to that order shall operate so as to permit any development specified in Part 1, Class A, B and C of the said schedule and no such development shall be carried out at any time without an express grant of planning permission under Part III of the Town and Country Planning Act 1990. Reason - In order to prevent the erection of extensions to the building so as to maintain its character and form which justified the replacement dwelling, in accordance with saved Policy RES9 of the Wychavon District Local Plan (June 2006)
Prior to the commencement of development hereby approved the following details shall be submitted to the local planning authority for approval in writing to ensure the dwelling is constructed to meet Level 3 of the Code for Sustainable Homes :- - details on how renewable energy measures are to be incorporated into the proposed development; - details of measures to conserve and recycling water to be incorporated into the proposed development; - details of energy efficiency measures to be incorporated into the proposed development; and - details of construction materials to be used in the proposed development with the aim of minimising the use of primary non-sustainable materials. The approved measures shall be implemented and incorporated into the approved development in line with a implementation timetable to be submitted and approved in writing by the local planning authority prior to the commencement of development. Reason - To ensure the prudent use of natural resources and to justify the increase in the volume of the replacement dwelling, in accordance with saved Policy RES9 of the Wychavon District Local Plan (June 2006)
This permission does not authorise the laying of private apparatus within the confines of the public highway The applicant should apply to the Worcestershire County Council's Community and Response Unit, County Hall, Spetchley Road, Worcester WR5 2NP (telephone 0845 607 2005), for consent under the New Roads and Streetworks Act 1991 to install private apparatus within the confines of the public highway. Precise details of all works within the public highway must be agreed on site with the Highway Authority.
This permission does not authorise the applicant to carry out works within the publicly maintained highway since such works can only be carried out by the County Council's Approved Contractor following the issue of a license under Section 184 and 278 of the Highways Act, 1980. The applicant should contact Worcestershire County Council's Highways Community and Response Unit, County Hall, Spetchley Road, Worcester WR5 2NP (telephone 0845 607 2005), regarding the issue of the necessary license authorising the access works to be carried out by the County Council's Approved Contractor at the applicant's expense. The applicant should give the County Council sufficient notice to enable, as far as possible, the licence procedure to be carried out so that there is no disruption to the applicant's programme of works.
The application site provides terrestrial habitat for Great Crested Newts and it is therefore possible that they could be present on site. Great Crested Newts are fully protected under the Wildlife and Countryside Act 1981 (as amended) and the Conservation of Habitats & Species Regulations 2010, the latter of which deems them a European Protected Species. It is a criminal offence to deliberately capture, kill or injure a great crested newt, to damage or destroy a breeding site or resting place or to intentionally or recklessly disturb any wild great crested newt while it is occupying a structure or place that it uses for shelter and protection. Should any Great Crested Newts be found, works must cease immediately and an ecological consultant must be contacted for advice on the best way to proceed in consultation with Natural England and the local planning authority. All contractors working on site should be made aware of the advice and provided with the contact details of a relevant ecological consultant.

In such ways the Council has demonstrated a positive and proactive manner in seeking solutions to problems arising in relation to the planning application.
