The mobile home is located outside of any defined development boundary as defined by the South Worcestershire Development Plan and would therefore lie in an area of open countryside, where new development is strictly controlled in accordance with SWDP2. The proposed development fails to accord with the provisions of policy SWDP2 of the SWDP. The development conflicts with the SWDP Development Strategy and the principles it is based upon (as set out under policy SWDP2) in that it would not safeguard or enhance the open countryside, encourage the effective use or re-use of accessible brownfield land or focus most development on the urban areas. The SWDP has been prepared and adopted in the context of the National Planning Policy Framework (NPPF) and its contents reflect the presumption in favour of sustainable development and guide how the presumption will be applied locally. To grant planning permission would also go against para 12 of the NPPF which emphasises that where a planning application conflicts with an up to date development plan (including any neighbourhood plans that form part of the development plan) permission should not normally be granted and advice at para 15 that “The planning system should be genuinely plan led”. Policy SWDP4 of the South Worcestershire Development Plan 2016 and the provisions of the National Planning Policy Framework require development to minimise the demand for travel and offer genuinely sustainable travel choices. Future occupiers of the mobile home would be highly reliant on the private car to get to and from the site. Furthermore, the site’s open countryside location beyond distances most people are willing to walk or cycle to access services, the distance to the nearest bus stop and lack of streetlighting, would result in future occupiers to be reliant on the use of the private car on a frequent basis to access facilities and services for their day to day needs. The proposal would therefore fail to represent sustainable development and is contrary to policies SWDP1, SWDP 2 and SWDP4 of the South Worcestershire Development Plan 2016 and guidance contained in the National Planning Policy Framework. |
Positive and Proactive Statement. In dealing with this application, the Council has worked with the applicant in the following ways: - providing pre-application advice; In such ways the Council has demonstrated a positive and proactive manner in seeking solutions to problems arising in relation to the planning application. This is in accordance with paragraph 38 of the NPPF. Despite these efforts, the Council still consider that planning permission should be refused for the reasons set out above. |
