The development hereby permitted shall be begun before the expiration of three years from the date of this permission.
Reason: To conform with the requirements of Section 91 of the Town and Country Planning Act 1990 as amended by Section 51 of the Planning and Compulsory Purchase Act 2004. |
Unless where required or allowed by other conditions attached to this permission/consent, the development hereby approved shall be carried out in accordance with the information (including details on the proposed materials) provided on the application form and the following plans/drawings/documents:
- Existing Site Location & Block Plans, Drawing no: TR1;
- Existing Elevation Drawings, Drawing no: TR2;
- Elevation Drawings, Drawing no: TR3 dated 20.5.2024;
- New Dwelling, Drawing no: TR4 received on 23rd January 2024;
- Street Scene, Drawing no: TR6 received on 28th March 2024;
- Proposed Block Plan, Drawing no: TR7 received on 8th April 2024;
- Water Management Statement and Energy Statement;
- Update Preliminary Ecological Appraisal by Worcestershire Wildlife Consultancy, Project no: 2023/048 A dated May 2023.
Reason: To define the permission. |
Prior to the first use/occupation of the development hereby permitted, the details set out in the submitted Water Management Statement shall be fully implemented and remain thereafter.
Reason: To ensure that an appropriate sustainable drainage system is provided to serve the development in accordance with policy SWDP29 of the South Worcestershire Development Plan 2016. |
Prior to the first use/occupation of the development hereby permitted, the details set out in the submitted Energy Statement shall be fully implemented and remain thereafter.
Reason: To ensure the use of renewable and/or low carbon energy sources are used in the development in accordance with policy SWDP27 of the South Worcestershire Development Plan 2016. |
Before the first use/occupation of the development hereby permitted a scheme of landscaping shall be submitted to and approved in writing by the Local Planning Authority.
The landscaping scheme shall include:-
(i) a plan(s) showing details of all existing trees and hedges on the application site including those to be removed and retained.
(ii) a plan(s) showing the layout of proposed tree, hedge and shrub planting and grass areas.
(iii) a schedule of proposed planting - indicating species, sizes at time of planting and numbers/densities of plants. This should have regard to the species suggestions made in Appendix 4 of the approved Update Preliminary Ecological Appraisal by Worcestershire Wildlife Consultancy ref: 2023/048 A and should include replacement tree planting. The replacement hedge alongside the highway and the boundary between the existing gardens to each dwelling should be of a native, species rich hedgerow.
(iv) a written specification outlining cultivation and other operations associated with plant and grass establishment.
(v) a schedule of maintenance, including watering and the control of competitive weed growth, for a minimum period of five years from first planting;
vi) retention and enhancement of the vegetation along the western boundary, plus details of protection of this boundary during the construction period.
All planting and seeding/turfing shall be carried out in accordance with the approved details in the first planting and seeding/turfing seasons following the completion or first occupation/use of the development, whichever is the sooner.
The planting shall be maintained in accordance with the approved schedule of maintenance. Any trees or plants which, within a period of five years from the completion of the planting, die, are removed or become seriously damaged or diseased shall be replaced in the next planting season with others of similar size and species.
Reason - To ensure the proposed development does not have an adverse effect on the character and appearance of the area in accordance with policies SWDP21, SWDP22 and SWDP25 of South Worcestershire Development Plan. |
The development hereby permitted shall be carried out in strict accordance with the recommendations set out in the Update Preliminary Ecological Appraisal report carried out by Worcestershire Wildlife Consultancy dated May 2023 and submitted with this application.
Reason: To ensure the development contributes to the conservation and enhancement of biodiversity within the site and the wider area in accordance with policy SWDP22 of the South Worcestershire Development Plan. |
Before the first /use occupation of the new dwelling hereby permitted, a bat roosting feature and bird nesting box shall be installed on the dwelling. The features shall be chosen from the list of Ecological Enhancements in Appendix 4 of the Update Preliminary Ecological Appraisal by Worcestershire Wildlife Consultany ref: 2023/048 A and once installed shall be retained in perpetuity.
The bat box shall be installed at a minimum height of 3m on a south, south-easterly, south-westerly or easterly elevation where there is no light nearby or directed onto the flight corridors towards the chosen elevation. The bird box shall be installed on a north or east-facing elevation in a high and sheltered position.
Reason: To ensure the development contributes to the conservation and enhancement of biodiversity within the site and the wider area in accordance with policy SWDP22 of the South Worcestershire Development Plan. |
Notwithstanding the provisions of the Town and Country Planning (General Permitted Development) Order 2015 (as amended) (or any order revoking, re-enacting, substituting, amending, extending, consolidating, replacing or modifying that Order), no additions, extensions or external alterations, new windows or other openings, building or enclosure, swimming or other pool, fence or wall required for a purpose incidental to the enjoyment of the dwelling house other than those expressly authorised by this permission shall be constructed/carried out on the application site following the completion/first use of the development hereby permitted.
Reason: In the interests of conserving nearby heritage assets in accordance with policies SWDP6 and SWDP24 of the South Worcestershire Development Plan. |
No building operations hereby permitted shall commence until details of the materials to be used in the construction of the external surfaces of the new dwelling and extension hereby permitted have been submitted to and approved in writing by the local planning authority.
The details to be submitted shall include:-
- type, colour, texture, size, coursing, finish, jointing and pointing of brickwork;
- type, colour, texture, size and design of roofing materials;
- sample panel of the brickwork, type of pointing and the mortar to be used with the panel kept on site for reference;
- details of the approved rooflights, including drawings showing design, materials and profile;
- details of the windows and doors including design and colour. Notwithstanding the approved plans, anthracite grey windows and doors shall not be used on the dwelling.
The development shall be carried out using the materials as approved.
Reason: To protect, conserve and enhance the significance of heritage assets and to ensure that the new materials are in keeping with the surroundings and/or represent quality design in accordance with policies SWDP 6, SWDP21 and SWDP24 of the South Worcestershire Development Plan. |
The Development hereby approved shall not be occupied until the access, visibility splays, parking and turning facilities have been provided as shown on approved drawing titled Proposed Block Plan (TR7) scale 1/500.
Reason: To ensure conformity with submitted details.

The Development hereby approved shall not be occupied until the first 5 metres of the shared access into the development, measured from the edge of the carriageway, has been surfaced in a bound material.
Reason: In the interests of highway safety.

Any new entrance gates shall be set back 5 metres from the adjoining carriageway edge and shall be made to open inwards only.

The development hereby permitted shall not commence until a Construction Environmental Management Plan (‘CEMP’) has been submitted to and approved in writing by the local planning authority. The CEMP shall provide for:
a) The parking of vehicles of site operatives and visitors within the
development site.
b) Loading and unloading of plant and materials within the development site. c) Storage of plant and materials within the development site.
d) Measures to ensure that vehicles leaving the site do not deposit mud or other detritus on the public highway.
e) Measures to control the emission of dust and dirt during construction.
f) Details of responsible persons and lines of communication.
g) Details of the routing of HGVs and delivery lorries associated with the proposed development to and from the site together with any agreed traffic management measures.
Thereafter, the construction of the development shall be undertaken in accordance with the approved CEMP.
Reason: In the interests of highway safety. |
Demolition, clearance or construction work and deliveries to and from the site in connection with the development hereby approved shall only take place between the hours of 08.00 and 18.00hrs Monday to Friday and 08.00 and 13.00hrs on a Saturday. There shall be no demolition, clearance or construction work or deliveries to and from the site on Sundays or Bank Holidays.
Reason - To preserve the amenities of the locality in accord with Policy SWDP21 of the South Worcestershire Development Plan. |
Prior to the first occupation of any of the dwelling hereby approved, superfast broadband facilities or alternative solutions to serve the dwelling hereby approved shall be provided.
Reason: To ensure the proposal incorporates satisfactory telecommunication facilities in line with policy SWDP26 of the South Worcestershire Development Plan 2016.

Before the development hereby permitted is first occupied/used, details of any external lighting to be provided in association with the development shall be submitted to and approved in writing by the Local Planning Authority. The details shall include times when the external lighting will not be switched on. Only external lighting in accordance with approved details shall be provided on the application site. Notwithstanding the provisions of the Town and Country Planning (General Permitted Development) Order 2015 (or any Order revoking or re-enacting that Order with or without modification) there shall be no other external lighting provided on the application site.
Lighting should be directed away from the western boundary.
Reason: To ensure the development contributes to the conservation and enhancement of biodiversity within the site and the wider area in accordance with policy SWDP22 of the South Worcestershire Development Plan. |
Positive and Proactive Statement. In dealing with this application, the Council has worked with the applicant in the following ways:-
- providing pre-application advice;
- seeking amendments to the proposed development following receipt of the application;
- considering the imposition of conditions and the completion of a s.106 legal agreement.
In such ways the Council has demonstrated a positive and proactive manner in seeking solutions to problems arising in relation to the planning application. |
The applicants attention is drawn to the existence of an agreement made under Section 106 of the Town and Country Planning Act 1990 (as amended), and the restrictions imposed therein. |
This permission does not authorise the applicant to carry out works within the publicly maintained highway since such works can only be carried out by the County Council’s Approved Contractor, Ringway Infrastructure Service who can be contacted by email worcestershirevehicle.crossing@ringway.co.uk. The applicant is solely responsible for all costs associated with construction of the access.
