Positive and Proactive Statement. In dealing with this application, the Council has worked with the applicant in the following ways:- providing pre-application advice; - seeking further information following receipt of the application; In such ways the Council has demonstrated a positive and proactive manner in seeking solutions to problems arising in relation to the planning application. This is in accordance with paragraph 38 of the NPPF. Despite these efforts, the Council still consider that planning permission should be refused for the reasons set out above. |
The wall that has been demolished internally is an original feature of the building and was part of the historic dairy layout. As such it has considerable significance and should be preserved. The design of the retrospective patio doors is domestic in nature and out of keeping with character of the historic agricultural building. The proposed porthole window is also not considered to be appropriate would be out of keeping with the character of the host building. The heritage statement has failed to provide adequate justification for any of the proposed works. The proposal would cause less than substantial harm to the Grade II (curtilage) Listed host property. No public benefits of the scheme have been identified which would justify the harm to the identified designated heritage assets. As such the proposal is considered contrary to the conservation aims of policies SWDP 6, SWDP21, SWDP 24 of the South Worcestershire Development Plan, and the aims and provisions contained within Section 16 of the National Planning Policy Framework (2023), specifically paragraphs 194 and 197. The scheme also fails to accord with the Planning (Listed Buildings and Conservation Areas) Act 1990. |
