Prior to the commencement of Phase 2 of the hereby approved development as shown on the Construction phasing plan ref. 11029-RL-XX-ZZ-DR-A P1002 Rev. P05, dated 22 February 2024 a scheme for a surface water drainage strategy for the proposed development has been submitted to, and approved in writing by the Local Planning Authority. The strategy shall include details of surface water drainage measures, including for hardstanding areas, and shall include the results of an assessment into the potential of disposing of surface water by means of a sustainable drainage system (SuDS) and the Roxel UK Flood Risk Assessment (April 2024, Rev P05). If and where possible infiltration techniques are to be used and the plan shall include the details and results of field percolation tests. The scheme shall provide detailed design drawings for all drainage assets and should include run off treatment proposals for surface water drainage. Exceedance flows should not be directed to property or private land. Where the scheme includes communal surface water drainage assets proposals for dealing with the future maintenance of these assets should be included. The scheme should include proposals for informing future occupiers of the arrangements for maintenance of communal surface water drainage assets. The approved surface water drainage scheme shall be implemented prior to the first use of the development and thereafter maintained in accordance with the agreed maintenance plan. Reason: To ensure appropriate drainage measures are achieved on site and to comply with SWDP 28 and SWDP 29. |
Prior to the hereby development being brought into use additional cycle parking shall be provided in accordance with the application details. The number of spaces and location shall be submitted to the Local Planning Authority for written approval. Thereafter the provision shall be retained for the purposes of cycle parking only at all times. Reason: To ensure that sufficient capacity for safe bicycle storage is available to promote sustainable transport methods. |
The Development hereby approved shall not be occupied and brought into use until a Travel Information Pack promoting sustainable forms of access to the development, has been submitted to and approved in writing by the Local Planning Authority. The pack shall be provided to each member of staff at the point of first employment from the date of this permission. Reason: To reduce vehicle movements and promote sustainable access. |
Within 7 days of works commencing in association with the proposed BNG measures, the Local Planning Authority should be provided with written notification of this fact. The details within the Habitat Management and Monitoring Plan V1, dated 8 August 2024, Biodiversity Net Gain Plan, ref. 187-E-RP-PL-1691BNP Rev. V2, dated 2 August 2024 and Habitat Enhancement Plan, ref. P8001 Rev. C01, dated 1 August 2024 shall then be strictly adhered to. All BNG works shall be completed prior to the first use of any of the hereby approved buildings or by the end of the first planting season following them being brought into first use, whichever is the later. For monitoring purposes, the Local Planning Authority should be provided with written notification of occupation within 28 days of first occupation. Reason: To ensure compliance with proposed BNG proposals and SWDP 22. |
Prior to the first use of the hereby approved development a management plan detailing future maintenance responsibilities for SuDS assets and associated pipework shall be submitted to and approved in writing by the Local Planning Authority. The plan should include proposals for informing future occupiers of the arrangements for upholding maintenance plans. The approved management plan shall be adhered to for the lifetime of the development. Reason: To ensure that appropriate measures are in place to maintain existing and proposed drainage infrastructure. |
No works in connection with site drainage shall take place until an exceedance flow routing plan for flows above the 1 in 100+40% event has been submitted to and approved in writing by the Local Planning Authority. The proposed scheme shall identify exceedance flow routes through the development based on proposed topography with flows being directed to highways and areas of POS. Flow routes through gardens and other areas in private ownership will not be permitted. The approved details shall be implemented in full prior to the first occupation of the development and maintained as such for the lifetime of the hereby approved development. Reason: To ensure that the scheme as proposed achieves appropriate drainage outcomes and to comply with SWDP 28 and 29. |
Before the development hereby permitted is first occupied/used, details of any external lighting to be provided in association with the development shall be submitted to and approved in writing by the Local Planning Authority. The details shall include times when the external lighting will not be switched on. Only external lighting in accordance with approved details shall be provided on the application site. Notwithstanding the provisions of the Town and Country Planning (General Permitted Development) Order 2015 (or any Order revoking or re-enacting that Order with or without modification) there shall be no other external lighting provided on the application site. Reason: To ensure the development contributes to the conservation and enhancement of biodiversity within the site and the wider area in accordance with policy SWDP22 of the South Worcestershire Development Plan. |
In the event that contamination is found at any time when carrying out the hereby approved development that was not previously identified in the Ground Investigation and Contamination Risk Assessment reports submitted in support of this application, construction works shall cease and this shall be reported immediately in writing to the Local Planning Authority. In such circumstances an investigation and risk assessment must be undertaken and a remediation scheme must be produced, submitted to and approved in writing by the Local Planning Authority. The measures as set out in the remediation scheme shall then be carried out in full. Following the completion of any measures identified in the approved remediation scheme a validation report must be produced, submitted to and approved in writing by the Local Planning Authority. Development works shall not resume until the remediation scheme and validation report have been approved in writing by the Local Planning Authority. Reason: To ensure that the proposed development avoids significant adverse impacts from pollution in accordance with policy SWDP31 of the South Worcestershire Development Plan. |
During the construction of the hereby approved development, the Wilson Associates document ‘Proposed Groundwater Monitoring Scheme’ shall be adhered to at all times. If the monitoring carried out in accordance with the proposed groundwater monitoring scheme shows any adverse risk of deterioration to water features (groundwater and surface water quality) the developer shall carry out the following procedures; 1. Cease construction works on site; 2. Investigate the cause of deterioration in water quality; 3. Propose appropriate measures to resolve the cause and remediate the identified cause including any further risks as well as proposing proposing greater frequency of monitoring groundwater; 4. Submit an updated Groundwater Monitoring scheme. Details of the cause of any deterioration of water quality and remediation proposals shall be submitted to the Local Planning Authority for written approval. Only once the remediation proposals have been approved shall works commence on site. Reason: To prevent any deterioration of ground or surface waters (‘controlled waters’ as defined under the Water Resources Act 1991). |
All planting and seeding/turfing comprised in the submitted landscape scheme, hereby approved, shall be carried out in the first planting season following the first occupation. All planting shall be watered as necessary and competitive weed growth controlled to ensure successful establishment. Any trees or plants that die, or are removed; or become seriously damaged or diseased within a period of five years from the completion of the planting, shall be replaced in the next planting season with others of similar size and species. Reason: To ensure the proposed development does not have an adverse effect on the character and appearance of the area in accordance with policies SWDP21 and SWDP25 of South Worcestershire Development Plan 2016. |
Within 1 month of the habitat creation and enhancement works set out in the Biodiversity Gain Plan and Habitat Management and Monitoring Plan (HMMP) V1, dated 8 August 2024 being completed, a completion report shall be submitted to the Local Planning Authority and the BNG monitoring fee shall be paid in full. Reason: To ensure compliance with proposed BNG proposals and SWDP 22. |
Ecological reports will be submitted to the Local Planning Authority in accordance with the Habitat Management and Monitoring Plan (HMMP) V1, dated 8 August 2024, plus or minus 30 days from the date of commencement of the BNG measures being implemented as confirmed by Condition 6. The reports should be provided at the following 2, 5, 10, 15, 20, 25 and 30 year intervals. The ecological reports will compare the ecological condition of the land with the approved plans and details within the Habitat Management and Monitoring Plan V1, dated 8 August 2024, Biodiversity Net Gain Plan, ref. 187-E-RP-PL-1691BNP Rev. V2, dated 2 August 2024 and Habitat Enhancement Plan, ref. P8001 Rev. C01, dated 1 August 2024. If the expected condition is not met ecological recommendations will be made to the Local Planning Authority for written approval. If any aspect of the land fails to meet the ecological conditions defined in the HMMP on 2 consecutive monitoring periods the Local planning authority will undertake what action is considered necessary to assure the delivery of the Biodiversity Net gain as described in the Habitat Management and Monitoring Plan, Habitat Enhancement Plan and Biodiversity Net Gain Plan. Reason: To ensure that the proposed BNG is delivered on site and complies with SWDP 22. |
Noise levels emitted from all external and/or externally ducted plant hereby approved shall not exceed the following levels at the nearest residential location as identified by the Noise Impact Assessment, ref. P23-383-R01v5, dated April 2024: Between 2300 – 0700 – Noise levels shall not exceed 36 dB and at all other times, 41 dB. Reason: In the interests of the amenity of the area. |
No demolition or construction works shall take place outside the hours of: 0700-1800 Monday to Friday; 0800-1600 Saturday; and No Activity on Sundays or Bank or Public Holidays Reason: In the interests of the amenity of the area. |
Foul and surface water shall be drained on separate systems. Reason: To secure proper drainage and to manage the risk of flooding and pollution. |

In the event that any protected species are discovered on site during construction works, works should cease and a qualified ecologist contacted for advice. Protected Species are protected under the 1981 Wildlife and Countryside Act and the Habitat Regulations 1994 and it is an offence to recklessly disturb or harm them. |
