No emergence surveys have been undertaken at this site, and therefore the Notification includes no information to demonstrate that protected species will not be harmed or put at risk of harm by the proposed development. Consequently, having regard to the issues identified in relation to European protected species, the Local Planning Authority is unable to discharge its duty to have regard to conserving protected species as part of its decision making in this case in regard to the Conservation of Habitats and Species Regulations 2017. The proposed works as such would fail to satisfy the requirements of Part 3, Class Q.2 (e) Schedule 2 of the Town and Country Planning (General Permitted Development) (England) Order, 2015 (as amended). |
