The development hereby permitted must be commenced not later than the expiration of three years from the date of the original permission 22/00172/FUL dated 24th August 2023.
Reason: To conform with the requirements of Sections 73 and 91 of the Town and Country Planning Act 1990 (as amended). |
Unless where required or allowed by other conditions attached to this permission/consent, the development hereby approved shall be carried out in accordance with the information (including details on the proposed materials) provided on the application form and the following plans/drawings/documents –

No building operations above floor slab level shall commence until details of the materials to be used in the construction of the external wall and roof surfaces of the dwelling hereby permitted have been submitted to and approved in writing by the local planning authority.
The development shall be carried out using the materials as approved.
Reason: To protect, conserve and enhance the significance of heritage assets and to ensure that the new materials are in keeping with the surroundings and/or represent quality design in accordance with policies SWDP 6, SWDP21 and SWDP24 of the South Worcestershire Development Plan. |
The development hereby permitted shall be carried out in strict accordance with the recommendations set out in the Bat Survey and Impact Assessment Report carried out by Countryside Consultants Ltd dated 12.10.21 and submitted with application, 22/00172/FUL. In particular:
- replacement bat house to be constructed to the south side of the garden.
- Lesser horseshoe hot box to be installed inside roof space of the bat house.
- 2 x integral bat boxes to be fitted to east and west elevations of new build.
- Timing of removal of vegetation to avoid disturbance to nesting birds
Reason: To ensure the development contributes to the conservation and enhancement of biodiversity within the site and the wider area in accordance with policy SWDP22 of the South Worcestershire Development Plan. |
Before the development hereby permitted is first occupied, details of any external lighting to be provided in association with the development shall be submitted to and approved in writing by the Local Planning Authority. The details shall include times when the external lighting will not be switched on. Only external lighting in accordance with approved details shall be provided on the application site. Notwithstanding the provisions of the Town and Country Planning (General Permitted Development) Order 2015 (or any Order revoking or re-enacting that Order with or without modification) there shall be no other external lighting provided on the application site.
Reason - To ensure the proposed development does not have an adverse effect on the character and appearance of the area in accordance with policies SWDP1, SWDP21 and SWDP25 of South Worcestershire Development Plan and to ensure the development contributes to the conservation and enhancement of biodiversity within the site and the wider area in accordance with policy SWDP22 of the South Worcestershire Development Plan. |
Prior to the first occupation of the development hereby permitted, the details set out in the submitted Water Management Statement shall be fully implemented and remain thereafter.
Reason: To ensure that an appropriate sustainable drainage system is provided to serve the development in accordance with policy SWDP29 of the South Worcestershire Development Plan 2016. |
Prior to the first occupation of the development hereby permitted the access,
turning area and parking facilities shall be provided in accordance with
2295/02B Site Plan as Proposed. These areas shall thereafter be retained
and kept available for their respective approved uses at all times.
Reason: To ensure highway safety in accordance with Policies SWDP 4 and SWDP 21 of the South Worcestershire Development Plan. |
Prior to the first occupation of the development hereby permitted the
proposed dwelling shall be fitted with an electric vehicle charging point
complying with BS EN 62196 Mode 3 or 4 charging and BS EN 61851 and the
Worcestershire County Council Streetscape Design Guide. The electric
vehicle charging point shall be retained for the lifetime of the development
unless it needs to be replaced in which case the replacement charging point
shall be of the same specification or a higher specification in terms of
charging performance.
Reason: To help reduce air pollution, to encourage sustainable travel and healthy communities in accordance with policies SWDP4, SWDP21 and SWDP31 of the South Worcestershire Development Plan 2016. |
Prior to the first occupation of the dwelling hereby approved secure parking for two cycles to comply with the Council’s standards shall be provided within the curtilage of the dwelling and these facilities shall thereafter be retained for the parking of cycles only.

Notwithstanding the provisions of the Town and Country Planning (General
Permitted Development) Order 2015 (as amended) (or any order revoking,
re-enacting, substituting, amending, extending, consolidating, replacing or
modifying that Order), no development falling within Classes A, B, C or D of
Schedule 2, Part 1 of the Town and Country Planning (General Permitted
Development) Order 2015 (as amended) other than those expressly
authorised by this permission shall be constructed on the application site.
Reason: To safeguard the character and appearance of the conservation area in accordance with Policies SWDP 6 and SWDP 24 of the South Worcestershire Development Plan. |
The development hereby permitted shall not be constructed beyond damp
proof course until details of the fenestration, glazing, doors, and chimney
have been submitted to and approved in writing by the Local Planning
Authority. Development shall be carried out in accordance with the approved
details.
Reason: to ensure the development conserves and enhances the conservation area in accordance with Policies SWDP 6 and SWDP 24 of the South Worcestershire Development Plan. |
Before the first occupation of the development hereby permitted a plan indicating the positions, design, materials and type of boundary treatment to be erected shall be submitted to and approved in writing by the local planning authority The boundary treatment shall include gaps for mammals and be completed before the first occupation of the development hereby permitted. Development shall be carried out in accordance with the approved details.
Reason - To protect the amenities of properties and ensure the proposed development does not have an adverse effect on the character and appearance of the area in accordance with policies SWDP21 and SWDP25 of South Worcestershire Development Plan.. |
Before the first occupation of the development hereby permitted a scheme of landscaping shall be submitted to and approved in writing by the Local Planning Authority. The landscaping scheme shall include:-
(i) a plan(s) showing details of all existing trees and hedges on the application site. The plan should include, for each tree/hedge, the accurate position, canopy spread and species, together with an indication of any proposals for felling/pruning and any proposed changes in ground level, or other works to be carried out, within the canopy spread.
(ii) a plan(s) showing the layout of proposed tree, hedge and shrub planting and grass areas.
(iii) a schedule of proposed planting - indicating species, sizes at time of planting and numbers/densities of plants.
(iv) a written specification outlining cultivation and other operations associated with plant and grass establishment.
(v) a schedule of maintenance, including watering and the control of competitive weed growth, for a minimum period of five years from first planting.
All planting and seeding/turfing shall be carried out in accordance with the approved details in the first planting and seeding/turfing seasons following the completion or first occupation of the development, whichever is the sooner.
The planting shall be maintained in accordance with the approved schedule of maintenance. Any trees or plants which, within a period of five years from the completion of the planting, die, are removed or become seriously damaged or diseased shall be replaced in the next planting season with others of similar size and species.
Reason - To ensure the proposed development does not have an adverse effect on the character and appearance of the area in accordance with policies SWDP21 and SWDP25 of South Worcestershire Development Plan. |
Temporary fencing for the protection of all retained trees/hedges on site and trees outside the site whose Root Protection Areas fall within the site shall be erected in accordance with BS 5837:2012 (Trees in Relation to Design, Demolition and Construction) before development of any type commences, including site clearance, demolition, materials delivery, vehicular movement and erection of site huts.
Any alternative fencing type or position not strictly in accordance with BS 5837 (2012) must be agreed in writing by the local planning authority prior to the commencement of development.
This protective fencing shall remain in place until the completion of development or unless otherwise agreed in writing with the local planning authority. Nothing should be stored or placed (including soil), nor shall any ground levels altered, within the fenced area without the previous written consent of the local planning authority. There shall be no burning of any material within 10 metres of the extent of the canopy of any retained tree/hedge.
Reason - To prevent existing trees/hedges from being damaged during construction work and to preserve the amenities of the locality. This is in accordance with policies SWDP21 and SWDP25 of the South Worcestershire Development Plan. |
Before the first occupation of the development hereby permitted, details of renewable and/or low carbon energy generation measures shall be submitted to and approved in writing by the Local Planning Authority. The measures shall contribute to at least 10% of the predicted energy requirements of the development. The details to be submitted shall include:-
- the overall predicted energy requirements of the approved development;
- the predicted energy generation from the proposed renewable/low carbon energy measures; and
- an implementation timetable for the proposed measures.
The development shall be carried out in accordance with the approved details.
Reason - To ensure the development supports the delivery of low carbon/renewable energy and safeguards natural resources in accordance with policy SWDP27 of the South Worcestershire Development Plan. |
All species of bats and their roosts (whether the bats are present or not) are protected from reckless killing, disturbance or destruction under both national and European legislation. Cracks, cavities and holes in trees and buildings can provide suitable places for bats to rest or hibernate; these should be carefully inspected prior to carrying out any works. If bats are discovered during work on trees or are suspected of being present, the relevant work should be halted and Natural England (formerly English Nature) notified and further advice sought (http://www.naturalengland.org.uk/).

All wild bird species are legally protected under the Wildlife and Countryside Act 1981 (as amended) from any form of disturbance between the onset of nest building and until such time as any dependent young have left the nest, principally from the beginning of March to the end of August. |
Positive and Proactive Statement. No problems have arisen in dealing with this application. The planning application sought an acceptable form of development consistent with the requirements of relevant policies and material considerations. No amendments or alterations were therefore required and no further positive or proactive action was deemed necessary. |
