The development hereby permitted shall be begun before the expiration of three years from the date of this permission.
Reason: To conform with the requirements of Section 91 of the Town and Country Planning Act 1990 as amended by Section 51 of the Planning and Compulsory Purchase Act 2004. |
Unless where required or allowed by other conditions attached to this permission/consent, the development hereby approved shall be carried out in accordance with the information (including details on the proposed materials) provided on the application form and the following plans/drawings/documents –

Reason: To define the permission in accordance with Policy SWDP1 and SWDP2 of the South Worcestershire Development Plan and the National Planning Policy Framework. |
Prior to its / their installation as part of the development hereby approved, details of the materials to be used in the construction of the external surfaces of the development hereby permitted shall be submitted to and approved in writing by the local planning authority. The details to be submitted shall include:-
- type, colour, texture, size, coursing, finish, jointing and pointing of brickwork/stonework;
- type, colour, texture, size and design of roofing materials;
- a precise specification of the proposed external render or plaster – including any decorative panels or patterns – and detailed specification of the mix, the number of coats and surface finish to be used;
- detailed specification of the new weatherboarding showing the dimensions, profile and a description of the stain or paint finish to be applied to the boarding:
- external joinery details along with architectural details of the proposed external finishes, heads, sills, position in wall reveal and any surrounding dressings;
- details of the approved rooflights, including design, materials and finish;
- details of external vents, ventilation slits, extracts and chimney flues including information on specification and colour;
- details of external doors/garage doors including information on finish;
The development shall be carried out using the materials as approved.
Reason - To ensure that the new materials are in keeping with the surroundings and/or represent quality design in accordance with policy SWDP21 of the South Worcestershire Development Plan. |
The development hereby permitted shall not be occupied/first used until full details of all foul and surface water drainage systems to serve the development have been submitted to and approved in writing by the Local Planning Authority. The approved drainage works shall be implemented in accordance with the approved details before the first occupation/use of the development hereby permitted and shall be retained thereafter.
Reason: To ensure development would not result in unacceptable risk of pollution or harm to the environment and to ensure the proposed development does not exacerbate flood risk and deals with surface water run-off from the site in a sustainable manner, in accordance with policies SWDP28, SWDP29 and SWDP 30 of the South Worcestershire Development Plan. |
Prior to the first use/occupation of the development hereby permitted a scheme of landscaping shall be submitted to and approved in writing by the Local Planning Authority. The landscaping scheme shall include:-
(i) a plan(s) showing details of all existing trees and hedges on the application site. The plan should include, for each tree/hedge, the accurate position, canopy spread and species, together with an indication of any proposals for felling/pruning and any proposed changes in ground level, or other works to be carried out, within the canopy spread.
(ii) a plan(s) showing the layout of proposed tree, hedge and shrub planting and grass areas.
(iii) a schedule of proposed planting - indicating species, sizes at time of planting and numbers/densities of plants.
(iv) a written specification outlining cultivation and other operations associated with plant and grass establishment.
(v) a schedule of maintenance, including watering and the control of competitive weed growth, for a minimum period of five years from first planting.
All planting and seeding/turfing shall be carried out in accordance with the approved details in the first planting and seeding/turfing seasons following the completion or first occupation/use of the development, whichever is the sooner.
The planting shall be maintained in accordance with the approved schedule of maintenance. Any trees or plants which, within a period of five years from the completion of the planting, die, are removed or become seriously damaged or diseased shall be replaced in the next planting season with others of similar size and species.
Reason - To ensure the proposed development does not have an adverse effect on the character and appearance of the area in accordance with policies SWDP21 and SWDP25 of South Worcestershire Development Plan. |
Prior to the first use/occupation of the development hereby permitted details of a precise specification of the proposed materials for the hard landscaping of the site (including roads, paths, parking areas and other hard surfaces) shall be submitted to and approved in writing by the local planning authority. The hard landscaping of the site shall be completed before the first use/occupation of the development hereby permitted. Development shall be carried out in accordance with the approved details.
Reason - To ensure the proposed development represents high quality design and does not have an adverse effect on the character and appearance of the area in accordance with policies SWDP21 and SWDP25 of South Worcestershire Development Plan. |
The Development hereby approved shall not be first occupied until the existing vehicular / pedestrian access shall be permanently closed in accordance with details that shall have been submitted to and approved in writing by the Local Planning Authority.
REASON: To ensure the safe and free flow of traffic using the adjoining highway in accordance with SWDP4. |
The Development hereby approved shall not be first occupied until the proposed access gates have been set back 5 metres from the adjoining carriageway edge and made to open inwards only.
REASON: In the interests of highway safety in accordance with SWDP4. |
The Development hereby approved shall not be first occupied until the first 5 metres of the access into the development, measured from the edge of the carriageway, has been surfaced in a bound material.
REASON: In the interests of highway safety, in accordance with SWDP4. |
Nothing shall be planted, erected and/or allowed to grow on the triangular area of land so formed which would obstruct the visibility described above.

Prior to the first use / occupation of the development hereby approved, the renewable energy generation measures, as set out within the Energy Statement submitted alongside this application with reference Ref: J008800/Energy, shall be implemented and retained thereafter.
The development shall be carried out in accordance with the approved details.
Reason - To ensure the development supports the delivery of low carbon/renewable energy and safeguards natural resources in accordance with policy SWDP27 of the South Worcestershire Development Plan. |
The development hereby permitted shall be carried out in strict accordance with the recommendations and mitigation measures as set out in the Preliminary Ecological Appraisal report report carried out by Arbor Vitae dated 05/09/2024 and submitted with this application. In particular:

- Habitat Mitigation to Include:
1. Retain the northern embankment as a habitat corridor of bracken and bramble.
2. Replace 30m of lost native hedge along the west boundary and plant a species-rich native hedge with trees along the east boundary, enhancing habitat and aiding nocturnal species.
3.
Establish a 15m radius buffer around the mature oak tree in the southeast of the site to protect its root zone, limiting construction activities within this area.
- Protected Species Mitigation to Include:
1. Create a landscape buffer along the eastern boundary, featuring a species-rich hedgerow with trees.
2.
Implement a Wildlife Sensitive Lighting Plan, including specific lighting measures to reduce impacts on nocturnal wildlife (e.g., low-level, motion-sensor lighting, no upward light spill).
3. Complete hedgerow removal outside of the bird breeding season (September-February) and provide 3 Woodcrete open-fronted nest boxes in mature trees for breeding birds.
- General Avoidance Measures to Include:

Disturb rubble or material piles by hand during the active season (March-October).

Maintain short grassland areas during construction to reduce wildlife attraction.
- Store materials on raised platforms to prevent use by wildlife.
- Open and close trenches within the same day, providing escape ramps if left open overnight.

Cap open pipework overnight and inspect trenches daily for trapped animals.
- Allow common reptiles or amphibians to naturally disperse and seek advice if large numbers are found.
In case of a great crested newt discovery, halt work and contact an ecologist and Natural England for guidance.
Reason: To ensure the development contributes to the conservation and enhancement of biodiversity within the site and the wider area in accordance with policy SWDP22 of the South Worcestershire Development Plan. |
The detached garage hereby permitted shall not be occupied at any time other than for purposes ancillary to the residential use of the approved dwelling. The garage shall not be used as an independent self contained dwelling separate from the approved dwelling.
Reason - To preserve the amenities of the locality in accord with Policy SWDP21 of the South Worcestershire Development Plan. |
Prior to the first use/occupation of the development hereby permitted, the details set out in the submitted Water Management Statement shall be fully implemented and remain thereafter.
Reason: To ensure that an appropriate sustainable drainage system is provided to serve the development in accordance with policy SWDP29 of the South Worcestershire Development Plan 2016. |
The first occupation of the dwelling shall be by a person or persons who is/are registered on the Part 1 of the District Council’s Self Build register and who had a primary input into the final design and layout of that dwelling.
The dwelling shall be occupied by this/these person(s) for a period of at least three years, unless otherwise agreed in writing by the Local Planning Authority.
Reason: To define the permission, having regard to the development applied for, to secure the delivery of the serviced plot(s) for self-build housing in accordance with Paragraph 73(b) of the National Planning Policy Framework. |
A S171 Licence, relevant to the Highway Act 1980, must be obtained from Highways
Network Management prior to undertaking any works within or excavation of the
adopted public highway. |
Positive and Proactive Statement. No problems have arisen in dealing with this application. The planning application sought an acceptable form of development consistent with the requirements of relevant policies and material considerations. No amendments or alterations were therefore required and no further positive or proactive action was deemed necessary. |
The applicants attention is drawn to the existence of an agreement made under Section 106 of the Town and Country Planning Act 1990 (as amended), and the restrictions imposed therein. |
