Condition Details / Information Notes |
The residential lodge units would be located outside of any defined development boundary in an area of open countryside away from services and amenities. Policy SWDP4 of the South Worcestershire Development Plan and the provisions of the National Planning Policy Framework require development to minimise the demand for travel and offer genuinely sustainable travel choices. The application site is located in the open countryside where genuine sustainable travel choices are either limited or not available for the future occupiers of the residential lodge units to travel to and from local services and facilities. Residents and visitors would be highly reliant on the private car to get to and from the site. The proposal would therefore not be locationally sustainable and is contrary to policy SWDP4, as well as SWDP2, of the South Worcestershire Development Plan. The proposal fails to accord with the adopted development plan and fails to represent sustainable development as defined by the Framework. There are no other material considerations, including the fact that the Council is currently unable to demonstrate a 5 year housing land supply, which indicate a departure from the development plan policy is justified and it is considered that the public benefits arising from the proposal do not outweigh the harm identified above, especially when combined with the other matters set out in this decision. |
The application submissions do not consider the issue of amenity for occupiers of the proposed homes as part of a predominately holiday home site where occupiers would be transitory and change regularly or whether the homes can achieve basic design standards as set out in the South Worcestershire Design Guide Supplementary Planning Document for dwellings. For example, there is no indication that adequate private amenity space of 20m2 per bedroom can be provided on a caravan site where the spacing of units is controlled under a site licence geared towards units being laid out for holiday purposes and where there is no fencing between plots. Similarly, the application does not consider the issue of how renewable energy measures can be incorporated within the proposed homes. In these ways, the proposal is contrary to Policies SWDP21 and SWDP27 of the South Worcestershire Development Plan. |
Whilst noting the applicants willingness to enter into a Section 106 legal agreement, no secure arrangements are in place to secure: - the provision of either on-site or a contribution towards off-site affordable housing, As such, the proposed development does not meet the objectives of sustainable development and cannot be delivered with acceptable impacts on the community and the environment. Therefore, the application is contrary to adopted South Worcestershire Development Plan Policies SWDP1, 7, 15 and SWDP 39 and guidance in the Council's Developer Contributions SPG and Affordable Housing SPG, as well as guidance contained in the National Planning Policy Framework. |

Positive and Proactive Statement. In dealing with this application, the Council has worked with the applicant in the following ways: - seeking further information following receipt of the application; and - considering the imposition of conditions and or the completion of a s.106 legal agreement. In such ways the Council has demonstrated a positive and proactive manner in seeking solutions to problems arising in relation to the planning application. This is in accordance with paragraph 39 of the NPPF. Despite these efforts, the Council still consider that planning permission should be refused for the reasons set out above. |
