Condition Details / Information Notes
The development for change of use of land as hereby permitted shall be begun before the expiration of three years from the date of this permission. Reason: To conform with the requirements of Section 91 of the Town and Country Planning Act 1990 as amended by Section 51 of the Planning and Compulsory Purchase Act 2004.
Unless where required or allowed by other conditions attached to this permission the development hereby approved shall be carried out in accordance with the information (including details on the proposed materials) provided on the application form and the following plans: Location Plan Scale 1:1250, Proposed Site Plan Scale 1:500, Proposed Floor Plan and Elevations of Outbuilding. Reason: To define the permission in accordance with Policy SWDP1 and SWDP2 of the South Worcestershire Development Plan and the National Planning Policy Framework.
The outbuilding hereby approved shall only be used privately, incidental to the dwellinghouse known as 'Carpenters' and shall not be used for any non-incidental trade, business or commercial enterprise whatsoever or converted to habitable accommodation. Reason: To prevent harm to the amenity of the local area and nearby residences in accordance with policies SWDP21 and SWDP31 of the South Worcestershire Development Plan.
Notwithstanding the provisions of the Town and Country Planning (General Permitted Development) Order 2015 (as amended) (or any order revoking, re-enacting, substituting, amending, extending, consolidating, replacing or modifying that Order), no building or enclosure, swimming or other pool required for a purpose incidental to the enjoyment of the dwelling house shall be constructed/carried out on the application site following the change of use of land to garden hereby permitted. Reason: To bring any future development of the property and its garden under planning control to protect the visual amenities of the area in accordance with Policy SWDP25 and protect the openness of the Green Belt in accordance with Policy SWDP2 of the South Worcestershire Development Plan (February 2016).
Notwithstanding the provisions of the Town and Country Planning (General Permitted Development) Order 2015 (as amended) (or any order revoking, re-enacting, substituting, amending, extending, consolidating, replacing or modifying that Order), no form of enclosure such as fences or walls shall be constructed around the land, following the change of use of land to garden hereby permitted. Reason: To bring any future development of the property and its garden under planning control to protect the visual amenities of the area in accordance with Policy SWDP25 of the South Worcestershire Development Plan (February 2016).
Prior to the first use of the development hereby permitted, the details set out in the submitted Water Management Statement shall be fully implemented and remain thereafter. Reason: To ensure that an appropriate sustainable drainage system is provided to serve the development in accordance with policy SWDP29 of the South Worcestershire Development Plan 2016.
Positive and Proactive Statement. No problems have arisen in dealing with this application. The planning application sought an acceptable form of development consistent with the requirements of relevant policies and material considerations. No amendments or alterations were therefore required and no further positive or proactive action was deemed necessary.
