Development under Class Q is permitted subject to the condition that development under Class Q must be carried out in accordance with the following approved plans:- 22013 (10) M-401, (10) M 101, (20) O-401, (25) M -401, (26) M-401. Reason: To define the permission.
The applicant should also be aware that Class Q only allows the provision of operational development to the actual building subject to conversion under the provisions of Class Q. The provision of operational development to create any additional form of hard surfacing to provide a vehicular/pedestrian means of access to the dwellings or for off road parking provision, other than currently exists on site, are not permitted by Class Q and would require separate planning permission. Therefore, notwithstanding the details on the approved plans, any indication of additional hard surfacing as shown on plan (10)-M 401, is not accepted and is not deemed to be granted prior approval.
Buildings, and particularly roofs and the spaces underneath them, are frequently used as roosting sites by bats. Bats and their 'roost' sites are protected under the Wildlife and Countryside Act 1981 (as amended) and the Conservation of Habitats & Species Regulations 2010, the latter of which deems them a European Protected Species. It is a criminal offence to deliberately kill or injure a bat, to disturb or destroy a bat roost or to obstruct an entrance to a roost. If evidence of bats is found, work should stop immediately and an ecological consultant contacted for advice on the best way to proceed. All contractors working on site should be made aware of the advice and provided with the contact details of a relevant ecological consultant.
Work should avoid disturbance to nesting birds. Nesting birds are protected under the 1981 Wildlife and Countryside Act and the Countryside and Rights of Way Act 2000. The main nesting season lasts approximately from March to September, so work should take place outside these dates if at all possible. However, birds can nest at any time and the site including any buildings should ideally be checked for their presence immediately before work starts.
The site is located adjacent to an Ancient Woodland and the applicant shall apply to the Forestry Commission prior to works commencing at https://www.legislation.gov.uk/uksi/1999/2228/regulation/2/made to establish whether an Environmental Impact Assessment is needed under the Environmental Impact Assessment (Forestry) (England and Wales) Regulations 1999, as amended.
